To mitigate those impacts, the developer of the project will be required to either participate in the City of Stockton Is Swainson's Hawk Habitat Conservation Plan or acquire and enhance replacement foraging habitat for the Swainson's hawk. 4.a. The EIR stated that the project-related pollutant emissions (carbon monoxide, ozone, and PM-14) would exceed the 'San Joaquin Valley Unified Air Pollution Control District's thresholds for significance and would incrementally contribute to regional air quality problems. In order to approve the application, the Board of Supervisors will be required to adopt both "Findings of Significant Environmental Impact" and "Statements of Overriding Considerations. " 5.a. The EIR concluded that the project would not result in any significant, unavoidable adverse impacts related to noise. 8.a. The developer will be required to annex the project site into the Lockeford Community Services District in order to have the Final Map approved. The District has already provided a will- serve letter for the provision of public water and sewage disposal services. 8.b. Neither the local school or fire districts will be significantly affected by the approval of the project, because the former has entered into an agreement with the developer to mitigate the impacts of the project and because the latter has indicated that the project' s impacts on its capabilities will be offset by the operation of a new fire station now under construction in the area. The EIR stated that the project, when combined with cumulative impacts from other projects, could have a significant, adverse impact law enforcement services if measures are not taken to provide additional law enforcement personnel.
