Item No. 2
PC: 10-22-92
ZR-92-13
Page 6
ATTACHMENT A
FINDINGS OF SIGNIFICANT ENVIRONMENTAL IMPACTS IDENTIFIED IN
THE RIVER OAKS ENVIRONMENTAL IMPACT REPORT
Section 15901(a) of the 'State CEOA Guidelines' states:
(a) No public agency shall approve or carry out a project for which an EIA has been completed which
identifies one or more significant environmental effects of the project unless the public agency
makes one or more written findings for each of those significant effects, accompanied by a brief
explanation of the rationale for each finding. The possible findings are:
(1) Changes or alterations have been required in, or incorporated into, the project which
avoid or substantially lessen the significant environmental effect as identified in the Final
EIR.
(2) Such changes or alterations are within the responsibility and jurisdiction of another public
agency and not the agency making the finding. Such changes have been adopted by
such other agency or can and should be adopted by such other agency.
(3) Specific economic, social, or other considerations make infeasible any mitigation
measures or project alternatives identified in the Final EIR.
1. Impact:
Development of the'site will result in the loss of oak trees and oak woodland habitat. Sixteen oak
trees would be removed, and the drip lines of at least fire others would be encroached into. An
additional 21 to 42 of the 210 oak trees in the area to be residentially developed could be
affected.
Mitigation:
a. Design the underlying project to maintain and protect the project site to the maximum
extent feasible (i.e., via utilization of cluster homes with common open space).
b. Require maintenance and management of nearly all Valley oaks on the site. Management
shall be done under the direction of an arborist according to 'Living Among the Oaks:
A Management Guide for Landowners` (UCCE, 1988).
c. Construct barriers around the dripline of trees during construction.
d. At a County-selected site, native oak trees shall be replanted for every one oak tree
removed from the site.
e. Establish a homeowners' association to maintain the common open space and the
existing and newly planted oak trees.
