Item No. 2 <br /> PC: 10-22-92 <br /> ZR-92-13 <br /> Page 6 <br /> ATTACHMENT A <br /> FINDINGS OF SIGNIFICANT ENVIRONMENTAL IMPACTS IDENTIFIED IN <br /> THE RIVER OAKS ENVIRONMENTAL IMPACT REPORT <br /> Section 15901(a) of the 'State CEOA Guidelines' states: <br /> (a) No public agency shall approve or carry out a project for which an EIA has been completed which <br /> identifies one or more significant environmental effects of the project unless the public agency <br /> makes one or more written findings for each of those significant effects, accompanied by a brief <br /> explanation of the rationale for each finding. The possible findings are: <br /> (1) Changes or alterations have been required in, or incorporated into, the project which <br /> avoid or substantially lessen the significant environmental effect as identified in the Final <br /> EIR. <br /> (2) Such changes or alterations are within the responsibility and jurisdiction of another public <br /> agency and not the agency making the finding. Such changes have been adopted by <br /> such other agency or can and should be adopted by such other agency. <br /> (3) Specific economic, social, or other considerations make infeasible any mitigation <br /> measures or project alternatives identified in the Final EIR. <br /> 1. Impact: <br /> Development of the'site will result in the loss of oak trees and oak woodland habitat. Sixteen oak <br /> trees would be removed, and the drip lines of at least fire others would be encroached into. An <br /> additional 21 to 42 of the 210 oak trees in the area to be residentially developed could be <br /> affected. <br /> Mitigation: <br /> a. Design the underlying project to maintain and protect the project site to the maximum <br /> extent feasible (i.e., via utilization of cluster homes with common open space). <br /> b. Require maintenance and management of nearly all Valley oaks on the site. Management <br /> shall be done under the direction of an arborist according to 'Living Among the Oaks: <br /> A Management Guide for Landowners` (UCCE, 1988). <br /> c. Construct barriers around the dripline of trees during construction. <br /> d. At a County-selected site, native oak trees shall be replanted for every one oak tree <br /> removed from the site. <br /> e. Establish a homeowners' association to maintain the common open space and the <br /> existing and newly planted oak trees. <br />
