Item No. 2 <br /> PC: 10-0-22-92 <br /> ZR-92-13 <br /> Page 7 <br /> Findings• <br /> a Changes or alterations have been required in, or incorporated into, the project which <br /> avoid or substantially lessen the significant environmental effect as identified in the Fina! <br /> EIR. <br /> b. Specific economic, social, or other considerations make infeasible any mitigation <br /> measures or project alternatives identified in the Final EIR. <br /> Supporting Facts: <br /> a The required mitigation measures will significantly reduce the impact of residential <br /> development on the oak trees. Also,trees will be planted at a second site on a three to <br /> one ratio. <br /> b. Agricultural use of the land, consistent with the existing designation and zoning of the <br /> site, could lead to the eventual decline and outright elimination of the oak grove, <br /> particularly if the trees are removed to facilitate utilization of the prime soil in the oak <br /> woodland area for intensive cultivation. <br /> 2. Impact: <br /> Project <br /> Project related air pollutant emissions (carton monoxide, ozone, and PM-10) would exceed the <br /> San Joaquin County Air Polluton Control District's thresholds for significance and would <br /> incrementally contribute to regional air quality problems. San Joaquin County is a nonattainment <br /> area for ozone and PM-10. <br /> Mitigations: <br /> The underlying project will be designed to enhance and encourage bicycle and pedestrian <br /> transportation to the nearby shopping area and other areas of the community.,� The EIR also <br /> stated that the Air Pollution Control District could develop an ordinance for approval by the Board <br /> of Supervisors that would prohitit conventional fireplaces and only permit EPA-approved <br /> woodstoves and fireplace inserts. <br /> Findings: <br /> a Such changes or alterations are within the responsibility and jurisdiction of another public <br /> agency and not the agency making the finding. Such changes have been adopted by <br /> such other agency or can and should be adopted by such other agency. <br /> b. Specific economic, social, or other considerations make infeasible any mitigation <br /> measures or project alternatives identified in the Final EIR. <br />
