PLANNING COMMISSION MINUTES <br /> OCTOBER 22 , 1992 <br /> 3 . ZONE RECLASSIFICATION APPLICATION NO. ZR-92-13 OF JOE TARANTINO <br /> ./ AND VICTOR & ROLAND GOTTI (C/O SAN JOAQUIN COUNTY) to rezone 124 .73 <br /> acres from AU-20 (Agriculture-Urban Reserve.; 20-acre minimum parcel <br /> size) to R-L (Low Density Residential) . The project site is <br /> located at the northeast corner of Brandt Road and Jack Tone Road, <br /> Lockeford (Supervisorial District 4) . <br /> Senior Planner Kerry Sullivan introduced a staff report into the <br /> record. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Luis Arismendi was present for this application and to <br /> answer questions. He said he was in favor of the zoning change. <br /> OPPONENTS: Ed Holden (18935 Tully Rd. ) said he wants to protect <br /> his water rights and was against the 26--acre lake. He said his <br /> property is ready to be subdivided. He said he is speaking at this <br /> hearing in order to keep his legal options open for the future. <br /> Comm. Gillispie suggested Mr. Holden attend the November . 5th <br /> hearing to hear the details of the subdivision proposal. <br /> REBUTTAL: Mr. Arismendi did not wish to speak in rebuttal. <br /> PUBLIC HEARING CLOSED <br /> Comm. Morri noted the tree replacement requirement for any removal <br /> of oak trees. <br /> Comm. Gillispie said he did not feel that the Statement of <br /> Overriding Considerations is sufficient in "Attachment B. " <br /> MOTION: Moved, seconded (Morri-Jungeblut) and carried by a vote of <br /> 6-1 to: <br /> i. Certify as adequate Final Environmental Impact Report No. ER- <br /> 90-3 under the provisions of Section 15090 of the California <br /> Environmental Quality Act (CEQA) ; <br /> 2 . Forward Zone Reclassification Application No. ZR-92-13 to the <br /> Board of Supervisors with a recommendation for approval based <br /> on the "Bases for Zone Reclassification" contained in the <br /> staff report; and <br /> 3 . Adopt "Findings of Significant Environmental Impact" (Attach- <br /> ment A) and a "Statement of Overriding Considerations" <br /> (Attachment B) . <br /> Vote- <br /> Ayes: Rojas, Bozzano, Holly, Morri, Jungeblut and Carter <br /> Noes: Gillispie <br /> Absent: None <br /> ------------------------------------------------------------------- <br /> -1- <br />
