Approved sanitary facilities must be provided for all employees. (Development <br /> Title Section 9-1100.1} <br /> 4. STATE DEPARTMENT OF FISH AND GAME <br /> a. Conduct Surveys for Nesting Raptors. A survey should be conducted by a qualified biologist during <br /> spring or early summer(April-July), before the start of each phase of mining activities near any <br /> suitable nest tree. If an active nest is located within 500 feet of an excavation area, the nest tree <br /> should be avoided during the nesting season (March-June 15) until the young have fledged. If an <br /> active nest tree cannot be avoided, the removal should occur after the breeding season (after June <br /> 15 and before March 1). <br /> b. Avoid Disturbance of Nesting Swainson's Hawk. If an active Swainson's hawk nest is found within <br /> 0.5 mile of the disturbance site, consult DFG and follow DFG mitigation guidelines for Swainson's <br /> hawks in the Central Valley. <br /> c. Compensate for Loss of Swainson's Hawk Foraging Habitat. Compensate for loss of Swainson's <br /> hawk foraging habitat on a 0.75:1 ratio. In all, 75 acres of suitable Swainson's hawk foraging habitat <br /> outside of the area to be excavated is required. <br /> 5. U. S. FISH AND WILDLIFE SERVICE <br /> I <br /> a. Protocol Survey for Vernal Pool Fairy Shrimp and Vernal Pool Tadpole Shrim . Protocol surveys <br /> begun in 1995 shall continue to be conducted by a qualified biologist to determine the distribution of sI <br /> vernal pool tadpole shrimp and vernal pool fairy shrimp. If either species is located in a seasonal <br /> wetlands that will be impacted, Section 9 of the Federal Endangered Species Act would be invoked if <br /> habitat cannot be avoided and is destroyed. <br /> 6. PACIFIC GAS AND ELECTRIC <br /> a. Tower Line Facilities: <br /> 1). Removal of any soil within 50 feet of any tower leg is prohibited. <br /> 2). A 3:1 slope cut must be maintained from the fringe point. <br /> 3). An access road 20 feet in width must be maintained within the center of the easement. <br /> b. Gas Main Facilities: <br /> 1). Access to all gas main facilities in the project area must be maintained. <br /> 2). A 25-foot setback from the easement boundary lines must be maintained from the excavation <br /> hinge point. <br /> 3). PG&E shall be notified at least 48 hours prior to any excavations in the vicinity of any gas mains <br /> through Underground Service Alert(USA)at(800)227-2600. <br /> 4).
