II . INTRODUCTION <br /> Facilities Requiring Coverage by This Plan. <br /> Under the Federal Water Pollution Control Act Amendments of <br /> 1972 (P.L. 92-500 ) , Environmental Protection Agency regulations <br /> regarding oil pollution prevention were enacted (40 CFR 112 as <br /> _ amended March 26 , 1976) . Under these regulations, all non- <br /> transportation related oil storage and consuming facilities must <br /> maintain an oil Spill Prevention Control and Countermeasure Plan <br /> (SPCC Plan) . Facilities to be included in such a Plan are: <br /> 1 . Underground storage facilities greater than 42,000 <br /> gallons; <br /> 2. Above ground storage facilities greater than 1,320 <br /> gallons with no single container greater than 660 <br /> gallons; <br /> 3. Above ground storage facilities with any single <br /> container greater than 600 gallons; <br /> 4. Facilities which, due to their locations and above- <br /> mentioned capacities, could reasonably be expected to <br /> _ discharge oil to the waters of the United States in the <br /> event of a spill. <br /> The ultimate purpose of the preparation and implementation <br /> of this Plan is to prevent spill events and to outline proper <br /> procedures to be taken in order to control such events. "Spill <br /> Event" means a discharge of oil into or upon the navigable waters <br /> — of the United States or adjoining shorelines in harmful <br /> quantities. "Oil" means oil of any kind or in any form, <br /> including petroleum, fuel oil, sludge oil refuse and oil mixed <br /> _ with wastes. The terms spill event, discharge, oil and navigable <br /> water are quite inclusive and are to be broadly interpreted. <br /> This plan will be reviewed and evaluated every three years <br /> by facility personnel. Any amendments or revisions deemed <br /> necessary will be certified by a Registered Professional <br /> Engineer. A record of reviewal dates and of changes made will be <br /> kept. <br /> Due to the location of the facility, it is highly unlikely <br /> that the facility could discharge oil into or upon the waters of <br /> the United States. This determination is based solely upon a <br /> consideration of the geographical and locational aspects of the <br /> facility and excludes consideration of man-made features. <br /> Nevertheless, this SPCC Plan has been prepared ( 1 ) to <br /> prevent discharges of oil into waters of the United States, and <br /> ( 2) to describe procedures which will be implemented, if <br /> necessary, in the event of any discharge. A Spill Event is <br /> referred to as a discharge of oil into or upon the navigable <br /> waters of the United States or adjoining shorelines in harmful <br /> quantities. Real or potential Spill Events are to be given <br /> 2 <br />
