Except as otherwise provided in State Mining Regulations,the County shall <br /> have authority to enforce provisions of the Surface Mining and Reclamation Act. The <br /> County may exercise all enforcement regulations available under the County Development <br /> Title and the State Public Resources Code. Such enforcement measures include <br /> charging the applicant the costs of administering an enforcement action. The basis for <br /> charging fees for an enforcement action shall be a time a materials compensation. <br /> (Development Title Section 9-1415.3(t)) <br /> t. State and Federal Permits. Prior to initiation of excavation activities that would result in <br /> the filling or degradation of waters of the United States (eastern portion of Phase Il, and <br /> Phases III and IV), the U. S. Army Corps of Engineers and the State Department of Fish <br /> and Game should be contacted to determine if a Section 404 and a Streambed Alteration <br /> Agreement, respectively, are necessary. <br /> U. Avoid Filling or Degrading Waters of the U. S., Including Wetlands. The excavation <br /> boundaries in the southeastern portion of the site shall be revised to exclude the seasonal <br /> wetlands that provide habitat for special-status shrimp species. The revised boundary <br /> shall be shown on the Improvement Plan. <br /> V. Conduct Summer Surveys for Late-Blooming Special-Status Plants. Before initiating <br /> excavation activities in areas that support vernal pool and seasonal wetland habiata <br /> (eastern portion of Phase ll, and Phases III and IV), a botanist shall be retained to <br /> conduct field surveys during the appropriate time of year (,lune-July). <br /> 2. DEPARTMENT OF PUBLIC WORKS: (Staff contact: Tom Iwamiya, 458-3000) <br /> a. Loads on County Roads. Loads on County roads shall be restricted to legal loads only. <br /> (Streets and Highway Title Section 10-2350) <br /> b. Video Tape of Brandt Road. A video tape of road conditions on Brandt Road from the <br /> entrance of the site to State Highway 88 is required prior to start of the excavation. The <br /> condition of County roads (haul route) shall be reviewed with the Department of Public <br /> Works prior to the start of excavation and every five years thereafter. (Development Title <br /> Section 9-1415.2) <br /> C. Bond for Brandt Road. A bond or cash deposit in the amount acceptable to the <br /> Department of Public Works shall be filed with the Department of Public Works with a <br /> guarantee that, if the permittee fails, refuses, or neglects to repair, under permit, any <br /> damages (including surface driveabiiity)to Brandt Road through to State Route 88, which <br /> may result from permittee's operations, the Department of Public Works may do the work <br /> necessary to restore the road equal to, or better than, its original condition, using the <br /> funds from said bond or cash deposit, subject to review and adjustment for inflation every <br /> five (5) years. The Department of Public Works shall notify KRC seven days prior to any <br /> necessary work. (Development Title Section 9-854.3) <br /> d. Flooding. If the proposed plan results in the diversion of runoff across watershed <br /> boundaries, thereby increasing the flood hazard to downstream properties, one of the <br /> following shall be accomplished by the applicant prior to the issuance of any permits for <br /> the project: <br /> Conditions of Approval - 4 - QX-94-2 <br />
