QX-94-0002 AVOID FILLING OR DEGRADING WATERS OF THE U.S. INCLUDING <br /> WETLANDS: The excavation boundaries in the southeastern portion of the site shall be revised <br /> to exclude the seasonal wetlands that provide habitat for special-status shrimp species for RMA 1 <br /> through 5. This condition shall apply until Final Reclamation is completed for these areas. <br /> y. QX-94-0002 AVOID OR REDUCE LOSS OF BLUE OAK WOODLAND: The operator shall <br /> exclude from the RMA 1 through 5, the 9 acres of blue oak woodlands shown on the Biological <br /> Resources Map contained in the Final Environmental Impact Report (SCH# 94102007). A <br /> minimum 10-foot-wide buffer shall also be established outside the dripline of blue oaks in the <br /> oakwoodland during excavation area. No construction or excavation activities shall occur within <br /> the fenced area. This condition shall apply until Final Reclamation is completed for these areas. <br /> The 9 acres of blue oak woodlands shall be shown on the Improvement Plan for PA-0600277. <br /> z. FEDERAL AND STATE ENDANGERED SPECIES ACT: In carrying out the operations of the <br /> proposed project, the applicant shall not take any actions that would violate the provisions of the <br /> State or Federal Endangered Species Acts or any regulations promulgated pursuant thereto. <br /> Compliance with said laws shall be the sole responsibility of the applicant, and the applicant <br /> agrees to indemnify, defend, and hold the County harmless from any against any claim or action <br /> by affected State or Federal agencies as to the project's compliance with said laws. <br /> aa. RECLAMATION: The site shall be reclaimed as indicated on the approved Amended <br /> Reclamation Plan dated November 5, 2013. <br /> bb. TIME LIMITATION: The Quarry Excavation Permit shall expire December 31, 2029. <br /> 2. PUBLIC WORKS DEPARTMENT (Staff Contact: Alex Chetley, 468-3000) <br /> a. Loads on all public roads shall be legal loads only. (Street and Highway Title Section 10-2350) <br /> b. An encroachment permit shall be required for all work within road right-of-way. The improvements <br /> shall be in conformance with the current Improvement Standards of the County of San Joaquin. <br /> Improvement plans, specifications and engineer's estimate prepared by a registered civil <br /> engineer shall be submitted for review and are subject to plan check, field inspection fees and <br /> must be approved by the County of San Joaquin Department of Public Works prior to issuance of <br /> the building permit. (Development Title Sections 9-240, 9-1145.4 and 9-1145.5) <br /> c. The following intersection improvements shall be completed prior to project mining activities in the <br /> expansion area: <br /> 1) On Mackville Road and Jahant Road as shown on Figure 10 of the Traffic Impact Study, a <br /> minimum of about 50 square feet of pavement shall be added on the outer edge to keep <br /> trucks form leaving the pavement. <br /> 2) On Jack Tone Road and Harney Lane as shown on Figure 12 of the Traffic Impact Study, a <br /> minimum of about 50 square feet of pavement shall be added on the outer edge to keep <br /> trucks form leaving the pavement. <br /> 3) On Clements Road and Harney Lane as shown on Figure 15 of the Traffic Impact Study, a <br /> minimum of about 100 square feet of pavement shall be added on the outer edge to keep <br /> trucks form leaving the pavement. <br /> 4) On Clements Road and Kettleman Lane as shown on Figure 16 of the Traffic Impact Study, a <br /> minimum of about 250 square feet of pavement shall be added on the outer edge to keep <br /> trucks form leaving the pavement. <br />
