C. CONSULTANT shall submit all,requests for data and/or reports to the Director of <br /> Community Development for disposition. The Consultant shall submit all matcrials <br /> directly to the,County Director of Community Development for review prior to making <br /> the materials available to the project applicant or other interested parlies. <br /> D. Upon completion of work or termination'of this Agreement,all reports,;including the <br /> roasters of the Draft and Final Environmental Impact Reports,and pertinent data or <br /> materials related to this Agreement shall,become the property of COUNTY and shall be <br /> delivered.to COUNTY forthwiih and prior to final payment-by COUNTY to <br /> CONSULTANT.CONSULTANT shall have the right to retain copies of documents <br /> delivered to COUNTY. <br /> i <br /> IV: PERSONNEL <br /> A. CONSULTANT SHALL employ,at its own expense,all personnel required to perform <br /> the services under this Agreement. Such personnel shall not be.employees of COUNTY. <br /> B. All of the services required by this Agreement shall be performed by CONSULTANT or <br /> its subcontractors as specified in Exhibit A,and all personnel engaged in the performance <br /> of such services shall be fully qualified and shall be authorized or permitted under <br /> Federal,State and local law to perform such services. <br /> C. No substitution of personnel identified in Exhibit A shall be made without the consent of <br /> the County Director of Community Development. <br /> V.TIME OF PERFORMANCE <br /> w <br /> Subject to earlier termination as herein provided,the services performed by CONSULTANT shall be in <br /> accord with schedule for completion contained in Exhibit A.The time for performance of services by <br /> CONSULTANT may be altered only upon the written consent of the County Director of Community <br /> Development. <br /> 1 VI, PAYMENT OF COMPENSATION <br /> A. For the full performance of the services described herein, COUNTY shall pay <br /> CONSULTANT the fixed total amount of$189,962.00. <br /> B. The$189,962.00shall be paid by COUNTY to CONSULTANT in accord with the <br /> following scheduler <br /> l. 40%,or$75,984.80 upon submission of an adequate Administrative Draft <br /> Environmental Impact Report,as determined by the County Director of <br /> Community Development; <br /> P <br /> 2. 30%,or$56,988.60 Upon submission of an adequate Draft Environmental <br /> Impact Report,as determined by the County Director of Community <br /> Development; <br /> 3. 20%,or$37,992.40 upon submission of an adequate Final Environmental <br /> Impact Report, as determined by the County Director of Community <br /> Development; <br /> 4. 10%,or$18,996.20 upon certification of the Final Environmental Impact Report <br /> by the Board of Supervisors of the County of San Joaquin. <br />
