The use of mercury, arsenic, or any other toxins on site is specifically prohibited. 2 _ Excavation below an elevation of 280 feet USGS datum is not allowed. 3 . Final elevations within 25 feet of any property boundary must be greater than the abutting property. 4 . Final and temporary slopes shall not exceed 2 feet horizontal to 1 foot vertical. (Section 9-2244 [m] ) ` 5. Vegetation and overburden shall not be removed from an area until the area is to be excavated. 6 . The topsoil 'hall be set aside and, upon completion of an excavation, the topsoil shall be replaced and the site leveled in conformance with the excavation permit. (Section 9-2244 [i] ) 7 . Stockpiled soil or material shall not be stored within 25 feet of a property boundary and shall be managed to minimize water and wind erosion. (Section 9-2244 [b] ) 8 . All water utilized in the plant operation shall be disposed of behind a closed dike. All retaining basins, settling ponds, ditches and diking shall be to the specifications of the Development Services Division. (Section 9-2244 [p] ) 9 . Storm drainage from exposed surfaces shall be designed to minimize erosion. The escape of silt to lower elevations shall be minimized through the use of hay bales or other method approved by the Development Services Division. 10 . Excavation operations shall not be carried on during the hours from nine (9) p.m. through five (5) a.m. except during periods of declared national, state, or local emergency. , Said hours are to be based on either Pacific Standard Time or Pacific Daylight Saving Time, whichever is legally in effect. (Section 9-2244 [f] ) 11. Any night lighting established on the property must be arranged and controlled so as not to illuminate public rights- of-way or adjacent properties. (Section 9-2244 [g] ) 12 . Private roads involved in the excavation must be maintained so as to control the creation of dust. The first 100 feet of the private road on the property which intersects with Brandt Road must be surfaced in a manner approved by the Department of Public Works. (Section 9-2244 [c] )
