The use of mercury, arsenic, or any other <br /> toxins on site is specifically prohibited. <br /> 2 _ Excavation below an elevation of 280 feet USGS datum is not <br /> allowed. <br /> 3 . Final elevations within 25 feet of any property boundary must <br /> be greater than the abutting property. <br /> 4 . Final and temporary slopes shall not exceed 2 feet horizontal <br /> to 1 foot vertical. (Section 9-2244 [m] ) <br />` 5. Vegetation and overburden shall not be removed from an area <br /> until the area is to be excavated. <br /> 6 . The topsoil 'hall be set aside and, upon completion of an <br /> excavation, the topsoil shall be replaced and the site leveled <br /> in conformance with the excavation permit. (Section 9-2244 [i] ) <br /> 7 . Stockpiled soil or material shall not be stored within 25 feet <br /> of a property boundary and shall be managed to minimize water <br /> and wind erosion. (Section 9-2244 [b] ) <br /> 8 . All water utilized in the plant operation shall be disposed of <br /> behind a closed dike. All retaining basins, settling ponds, <br /> ditches and diking shall be to the specifications of the <br /> Development Services Division. (Section 9-2244 [p] ) <br /> 9 . Storm drainage from exposed surfaces shall be designed to <br /> minimize erosion. The escape of silt to lower elevations <br /> shall be minimized through the use of hay bales or other <br /> method approved by the Development Services Division. <br /> 10 . Excavation operations shall not be carried on during the hours <br /> from nine (9) p.m. through five (5) a.m. except during periods <br /> of declared national, state, or local emergency. , Said hours <br /> are to be based on either Pacific Standard Time or Pacific <br /> Daylight Saving Time, whichever is legally in effect. (Section <br /> 9-2244 [f] ) <br /> 11. Any night lighting established on the property must be <br /> arranged and controlled so as not to illuminate public rights- <br /> of-way or adjacent properties. (Section 9-2244 [g] ) <br /> 12 . Private roads involved in the excavation must be maintained so <br /> as to control the creation of dust. The first 100 feet of the <br /> private road on the property which intersects with Brandt Road <br /> must be surfaced in a manner approved by the Department of <br /> Public Works. (Section 9-2244 [c] ) <br />
