CONDITION OF APPROVAL -2- <br /> MS-92-0197 <br /> d. The Water Supply Facilities Impact Mitigation Fee will be <br /> required when parcels are developed. The fee is due and <br /> payable at the time of building permit application. (The <br /> fee currently is $1, 069. 00 per single family dwelling <br /> unit. If there is no building permit required, the fee <br /> will be exempt. The fee shall be automatically increased <br /> on January 1 of each year at the rate of 6. 9 percent. An <br /> additional 3 . 5 percent shall be added to the fee upon <br /> payment for processing and administering the program. <br /> (Resolution R-91.-327) <br /> 3 . PUBLIC HEALTH SERVICES: <br /> a. Open, pump, and backfill the septic tank, seepage pit or <br /> excavation under permit and inspection by the <br /> Environmental Health Division (Ordinance Code Section 5- <br /> 3003) . <br /> b. Connection to a public sewer system is required <br /> (Ordinance Code Section 9-10002) . <br /> C. Connection to an approved public water supply system is <br /> required. <br /> 4 . SAN JOAQUIN COUNTY COUNSEL: <br /> a. Pursuant to Section 66474 . 9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the <br /> local agency or its agents, officers, and employees from <br /> any claim, action, or proceeding against the local agency <br /> or its agents, officers, or employees to attack, set <br /> aside, void, or annul an approval of the local agency, <br /> advisory agency, appeal board, or legislative body <br /> concerning a subdivision, which action is brought within <br /> the time provided for in Section 66499 . 37 of the <br /> Government Code. <br />
