Analysis <br /> This item, which would normally be processed at staff level, is being referred to the Planning Commission <br /> due to drainage issues and opposition by the Lodi Unified School District. <br /> Schools <br /> The Lodi Unified School District has asked the owner to agree to a development fee in the amount of <br /> $2.91 per square foot. Because the owner has not agreed to that fee, the school district asks that a <br /> Mello-Roos District be formed as a condition of the tentative map. The new Mello-Roos District will consist <br /> solely of this property, with other properties to be annexed as new subdivisions are approved within the <br /> Lodi Unified School district. <br /> Drainage <br /> This application was submitted on December 30, 1994, with a request for natural drainage. At that time, <br /> terminal drainage was required for subdivisions in Urban Communities. This application was placed on <br /> hold while General Plan Application No. GP-95-�3 and Text Amendment Application No. TA-95-3 were <br /> processed to allow on-site retention ponds on lots greater than two acres in size for subdivisions in areas <br /> designated Rural Residential in Urban Communities. Those provisions became effective September 8, <br /> 1995.
