i rf <br /> -2- <br /> The church employs a total of four people. The hours of operation for the proposed church will <br /> f remain the same as the existing facility. The church currently holds services on Saturday at 5:00 <br /> p.m. and 7:00 p.m. and on Sunday at 8:00 a.m., 10:00 a.m. and 11:30 a.m. In addition, there is a <br /> daily mass at 8:00 a.m., Monday through Thursday. The proposed K-8 school will operate <br /> Monday through Friday from 8:00 a.m. to 4:00 p.m. and is anticipated to employ a total of <br /> twelve people. The multi-purpose building will be used for church functions and gatherings. <br /> The site currently has an existing single family residence which will remain. <br /> On May 13, 2009, the Community Development Department received a petition in favor of the <br /> project signed by 815 people. (Attachment `A') <br /> REASON FOR RECOMMENDATION: <br />{ <br /> The Planning Commission heard this matter at its regular meeting on March 19, 2009. Five <br /> people spoke in favor of the project; three people spoke in opposition. After consideration of all <br /> oral and written testimony, the Planning Commission voted 4-0 to approve the Negative <br /> Declaration and approve the Use Permit. On March 30, 2009, James Colton appealed the <br /> Planning Commission's approval of the Use Permit to the Board of Supervisors. <br /> APPEAL STATEMENT NO. 1 <br /> "Public notices were received only 10 days before Planning Commission hearing. This was not <br /> enough time to acquire and review environmental documents and traffic impact analysis report. <br /> This was also not enough time for neighbors outside the 1400 sq ft mailing perimeter,to be <br /> informed and be able to make an educated response to the project." <br /> RESPONSE TO APPEAL STATEMENT NO. 1 <br /> The Development Title and the California Environmental Quality Act (CEQA) specify public <br /> review requirements for Public Hearing items and proposed Negative Declarations respectively. <br /> For applications subject to the Public Hearing Review Procedure, Section 9-220.8 of the <br /> Development Title requires that all owners within 1,400 feet of the perimeter be notified 10 days <br /> prior to the Public Hearing. For proposed Negative Declarations sent to the State Clearinghouse, <br /> the public review period is 30 days (CEQA Guidelines, 15105[b]). Consistent with those <br /> requirements, a notice indicating that the County was proposing a Negative Declaration was <br /> mailed on June 19, 2007, and notice of the Public Hearing was mailed on March 6, 2009. <br />
