Hazelton Avenue Stockton, CA 95205 OAK FARM VINEYARDS APPLICATION REFERRAL, PA-1200192 (SA), SAN JOAQUIN COUNTY The Central Valley Regional Water Quality Control Board (Central Valley Water Board) recently received an Application Referral from the San Joaquin County Community Development Department, Development Services Division, dated 5 October 2012, which described the proposed expansion of an existing small winery located at 23627 N. De Vries Road in Lodi, California (APN No. 003-040-03). The Central Valley Water Board is responsible for protecting the quality of surface and ground waters of the state; therefore our comments will address concerns surrounding those issues. Depending on details not provided to us for review, a Negative Declaration may be appropriate for the project. The applicant is requesting to expand an existing wine cellar into a small winery. Facility expansion will include the construction of a 6,000 square foot production facility, an 800 square foot crushing pad, a 3,600 square foot tasting room, and an additional 8,000 feet in production areas planned over a ten year period. The Application Referral did not provide details of anticipated wastewater volumes or treatment, but an attached Site Plan to the application did indicate the location of two planned 6,000 gallon wastewater storage tanks and existing septic systems on the property. Waste Discharge Requirements If winery process wastewater will be discharged to land, the discharge is subject to regulation by the Central Valley Water Board under Waste Discharge Requirements (WDRs). In accordance with California Water Code section 13260, the project proponent is required to submit a Report of Waste Discharge (RWD) at least 180 days prior to operating the winery. Many small wineries that either transport such waste offsite for disposal at a permitted facility or apply process wastewater and residual solids to land can qualify for coverage under a conditional general waiver of WDRs that was adopted by the Central Valley Water Quality Control Board in 2009 under the heading "Small Food Processors and Small Wineries— Order No. R5-2009-0097."
