Nonconforming Structure <br /> Development Title Section 9-235.4 (2) states that a nonconforming structure may be <br /> added to or enlarged within the yard setback area provided the expansion does not <br /> increase the linear measurement of the portion of the building within the setback area by <br /> more than one hundred percent (100%). Expansions within the yard setback area <br /> greater than one hundred percent (100%) will require an approved Site Approval. The <br /> applicant could expand the existing building up to fifty-five (55)feet within the existing <br /> side yard setback area and propose the remaining expansion within the existing side <br /> yard setback area of ten (10) feet with a Site Approval application. If the applicant <br /> decides to choose this route, a Variance application would not be required. <br /> The application is scheduled to be heard b the Planning <br /> l Y g Commission on August 3 <br /> 2006 pending any outstanding issues.
