Based on the complaint, it appears possible that contamination
may exist at this facility. The extent of the contamination, if any, is
unknown.
Live Oak searched the San Joaquin County Haz Mat Viewer on August 15, 2017
for the Site and nearby facilities with hazardous materials inventories. The Site
was not listed. One facility was identified within one-quarter mile, Ag-Ray (20400
N. Kennefick), with a chemical inventory of acetylene gas and oxygen gas.
Based on the distance from the structures to the Site, no impact is anticipated.
Live Oak reviewed the San Joaquin County Environmental Health Department's
Water Well Data Table dated March 10, 2009 for nearby addresses that have
been tested for nitrate and dibromochloropropane (DBCP). Eight wells were
identified at addresses within approximately one-half mile of the subject Site. Six
of the wells had been tested for DBCP; it was detected in five wells, at
concentrations of 0.090 to 4.27 [g/L. Five of the wells had been tested for
nitrate; it was detected in all five at concentrations of 1.0 to 50 mg/L- NO3. The
Maximum Contaminant Level (MCL) set by the US EPA for nitrate as NO3 is 45
mg/L. The MCL for DBCP is 0.2 µg/L.
• 7.3 Agricultural Commissioner's Records
The San Joaquin County Agricultural Commissioner's Office was contacted
regarding agricultural use of the site. Chemical application records were
identified under the names of David Malitz and Brooks & Erman. According to
the records, Brooks & Erman grew corn for fodder on the Site in 2015, and
applied Zeal miticide (etoxazole) at that time. David Malitz grew oats for fodder
from 2007 through 2011 and applied Shark EW (carfentrazone-ethyl) and
Weedar (2,4-D, dimethylamine salt). The chemical application records are
attached in Appendix 5.
7.4 Department of Oil, Gas, and Geothermal Resources Maps
The California Department of Oil, Gas, and Geothermal Resources (DOGGR)
Online Mapping System (DOMS) was queried on August 15, 2017 for mapped oil
or gas wells within one-quarter mile of the subject Site. No wells were identified
within the search radius.
•
LOGE 1720 7
