CONDITIONS OF APPROVAL <br /> PA-1400209 <br /> CALOSSO/SEIBEL <br /> Minor Subdivision application No. PA-1400209 was approved by the San Joaquin County <br /> Community Development Department on March 4, 2015. The effective date of approval is March 14, <br /> 2015. This tentative map approval will expire on March 13, 2018, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and <br /> (2) a Certificate of Compliance has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Certificate of Compliance. Those Conditions followed by a Section Number <br /> have been identified as ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: Megan Aguirre, [209] 468-3144) <br /> a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved tentative map dated November 21, 2014. A fee is required to process the <br /> Certificate of Compliance application. (Development Title Section 9-890.4) <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br /> be recorded as a Notice of Minor Subdivision Restriction with the Certificate of Compliance: <br /> (1) All persons purchasing parcels within the boundaries of this approved map should be prepared <br /> to accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 80.00 gross acres. (Development Title Section 9- <br /> 610.2) <br /> d. TREE PRESERVATION: Future development on the parcel(s) shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance (Development Title Section 9-1505.2). A <br /> Notice of Minor Subdivision Restriction shall be recorded that states: <br /> (1) The removal of a Native Oak Tree, Heritage Oak Tree, or Historical Tree shall require an <br /> approved Improvement Plan application. Replacement of any tree removed under Development <br /> Title Section 9-1505.3 shall be as specified in Section 9-1505.4. <br /> e. RIPARIAN HABITAT: Parallel to Dry Creek and Goose Creek, natural open space areas for riparian <br /> habitat and waterway protection shall be maintained to provide nesting and foraging habitat and the <br /> protection of waterway quality. The minimum width of said open space shall be one-hundred (100) <br /> feet, measured from the mean high water level of the natural bank or fifty (50) feet back from the <br /> existing riparian habitat, whichever is greater. Water-dependent uses may be permitted in this buffer. <br /> The mean high water level and the edge of the riparian habitat shall be recorded as a Notice of Minor <br /> Subdivision Restriction.
