(1) Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection. No <br /> development other than water dependent uses shall be permitted in this space. <br /> f. ACCESS: The following access requirements apply and shall be included in the Certificate of <br /> Compliance property description: <br /> (1) A proposed minimum 25-foot wide private easement for access to Parcel 1, that extends <br /> northeast from Prouty Road along the southern boundary of Parcel 2, shall be included in the <br /> property description for the Certificate of Compliance. (Development Title Section 9-1150.15) <br /> (2) A proposed 25-foot wide private easement for access to Parcels 8-10 and 12-15 that extends <br /> west and then south from Prouty Road through Parcel 6, along the northern property lines of <br /> Parcels 9 and 10, and along the western property lines of Parcels 13 and 14, shall be included in <br /> the property description for the Certificate of Compliance. (Development Title Section 9-1150-15) <br /> (3) The following note shall be included in the Certificate of Compliance and also shall be recorded <br /> as a separate instrument: <br /> (a) At the time of development of Parcels 1, 8, 9, 10, 12, 13, 14, or 15, the entire length of the <br /> private right-of-way for that parcel shall be constructed and maintained to the standards <br /> required by Section 10.207 of the Uniform Fire Code and applicable San Joaquin County <br /> Improvement Standards. (Development Title Section 9-1150.15[c]) <br /> g. FLOOD HAZARDS: Future construction on the parcel(s) shall be consistent with the requirements of <br /> the Flood Hazards Chapter. (Development Title Section 9-1605) <br /> h. ROAD NAMES: All subdivision road names shall be submitted to the Community Development <br /> Department for approval by the Director. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> 3. SAN JOAQUIN COUNCIL OF GOVERNMENTS (Staff Contact: Laurel Boyd, [209] 235-0600, see the <br /> memo dated December 2, 2014) <br /> a. This project is subject to the San Joaquin County Multi-Species Habitat Conservation and Open <br /> Space Plan (SJMSCP). At the time of development, any structures that require ground <br /> disturbance on this or subsequent divided parcels will be subject to participate in the SJMSCP <br /> and should be resubmitted to the San Joaquin Council of Governments to ensure biological and <br /> mitigation obligations are satisfied. The following note shall be recorded as a Notice of Minor <br /> Subdivision Restriction: <br /> (1) Parcels 1 through 15 are subject to the San Joaquin County Multi-Species Habitat <br /> Conservation and Open Space Plan (SJMSCP).
