i <br /> 4 <br /> t Analysis . <br /> Background <br /> The applicant, the Noble Yacht Group, has been operating a private recreational facility at this location <br /> without benefit of the necessary permits for several years. When the applicants recently sought to obtain <br /> permits from the Army Corps of Engineers and the State Lands Commission for existing unpermitted <br /> structures and the proposed placement of riprap along the western tip of the island for erosion control, it <br /> was noted that they had not obtained the necessary local permits for the existing facility. <br /> The facility is open only to members of the Noble Yacht Group, which consists of 53 members with 37 <br /> boats. The members keep their boats in various marinas in the area, and no boats will be berthed or <br /> stored a the site. Members of the Noble Yacht Group may use the docks free of charge for recreational <br /> purposes. During the summer months, there are typically five or six boats tied up at the island over a <br /> weekend. On holiday weekends, this number may rise to 15 boats. Members use the facility for <br /> cookouts, socializing, and swimming. There are no sanitary facilities existing or proposed, as members <br /> have such facilities on their boats. No pump-out facilities are existing or proposed, as members would <br /> typically utilize the pump-out facilities located at the marina where they store their boat. <br /> Conservation Easement <br /> i <br /> Prior to submittal of this Use Permit application, the applicant has cooperated with the U. S. Fish and <br /> Wildlife Service (USFWS) and the Army Corps of Engineers (ACOE) to reach an agreement regarding <br /> the Conservation Easement that was developed as the main element of a mitigation enhancement plan <br /> for resources impacted by unpermitted construction and proposed placement of riprap for bank <br /> protection. <br /> The applicants are proposing to set aside, in perpetuity, approximately 3.5 acres of the eastern tip of the <br /> island as a wildlife area. .This would provide protection to a large block of native shrub scrub habitat and <br /> approximately 1,500 linear feet of shaded riverine aquatic habitat. The area would be granted to the <br /> .California Department of Fish and Game (DFG). The applicants are working directly with USFWS, <br /> ACOS, and DFG on this issue. <br /> 41 <br /> Flooding <br /> The cabana is built on piers, with no enclosed foundation or other impediments to flowing water in the <br /> event of flooding.
