Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Use Permit No. UP-97-8 with the Findings and Conditions of Approval contained
in the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any
applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
a. This finding can be made because private recreation facilities may be permitted in the
AG zone with an approved Use Permit.
2_ Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
a. This finding can be made because the site will be accessible only by water to
members only, who will use sanitary facilities located in their boats.
3. The site is physically suitable for the type of development and for the intensity of development.
a. This finding can be made because the site contains 6.1 acres, and development will be
minimal.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be
F injurious to the property or improvements of adjacent properties.
a. This finding can be made because the Initial Study prepared for this project found no
potentially significant, adverse impacts, and a Negative Declaration was prepared.
5. The use is compatible with adjoining land uses.
a. This finding can be made because the project is in the San Joaquin Delta, which is
used extensively for aquatic recreation.
UP-97-8/Noble Yacht Group
San Joaquin County
Community Development Page 6
