A covenant to grant a perpetual exclusive easement for maintenance and construction along the Calaveras <br /> River shall be recorded prior to approval of the parcel map. Said easement shall be no less than fifty feet <br /> (50')measured perpendicularly inward(landside) from the Calaveras River bank hinge outward towards the <br /> northerly property line,between the east and west property lines of Parcel 1 and the"Designated <br /> Remainder" (APN 065-070-10). Contact the Flood Management Division of the Department of Public <br /> Works(209-468-7612)for processing said covenant. (California Water Code Section 79-5) <br /> Informational Notes: <br /> (i.) Any work done within 30 feet of the southerly bank of the Calaveras River shall require a permit from the <br /> Central Valley Flood Protection Board or a San Joaquin County Watercourse Encroachment Permit as <br /> applicable. <br /> (ii.) Any construction activity that results in the disturbance of at least one(1)acre of soil shall require a State <br /> NPDES construction permit. Dischargers whose projects disturb 1 or more acres of soil or whose projects <br /> disturb less than 1 acre of soil and is not part of a larger common plan of development, are required to <br /> obtain coverage under the current General Permit for Discharges of Storm Water Associated with <br /> Construction Activity(www.swrcb.ca.gov/stormwtr/gen_const.htmlgconst_permit). <br /> (iii.) All future building permits for projects located within a Special Flood Hazard Area at the time of permit <br /> issuance shall meet the San Joaquin County flood hazard reduction requirements(Title 9, Chapter 9-1605) <br /> and all requirements of the State of California(CCR Title 23)that are in force at the time of permit <br /> issuance.
