(1) The applicant causes the excavation to become idle without an approved interim <br /> management plan for a period of 18 months or more; <br /> (2) The applicant files for bankruptcy; <br /> (3) The County or State determines on the basis of annual inspections and reports <br /> that the applicant has not maintained compliance with the approved permit; <br /> (4) There arises an occurrence or circumstance which, in the opinion of the County <br /> or State, jeopardizes the site reclamation; or <br /> (5) The State makes one or more of the findings specified in Section 2774.4(a) of the <br /> State Public Resources Code. <br /> In any instance that the County or Stade makes the demand for partial or full tender of the <br /> financial guarantee of performance, the County and/or State may use all or any portion: <br /> of the financial guarantee to reclaim the site and to recover its administrative costs <br /> associated therewith. (Developmerrt Title Section 9-1415.2(r}) <br /> r. In pits used to store excess flood flows from lone Tree Creek, agricultural chemicals that <br /> could contaminate groundwater to the point of impairing beneficial uses shall not be <br /> applied before April 1 of each calendar year or after the last date that the material could <br /> be applied and still decompose to negligible residual concentrations in the soil by <br /> December 1. Nitrogen shall not be applied in excess of crop uptake, particularly in the <br /> fall. <br /> S. Submit for approval to Development Services Division and the appropriate affected <br /> agencies the detailed plans and specifications to apply for encroachment permits <br /> concerning arty proposed conveyor and/or excavation equipment crossings over or under <br /> Interstate 5, the California Aqueduct, lone Tree Creek, Biewett Road, Hetch Hetchy <br /> pipeline, PG&E pipelines, Chevron USA Inc. pipeline, or any other easements. <br /> L The excavator shall cease all construction and excavation work immediately upon the <br /> discovery of cultural resource materials. Such work shall cease until the excavator has <br /> complied with the requirements of Appendix K of the CEQA Guidelines. <br /> U. The excavator shall implement the following measures to reduce the impact of <br /> construction-related noise: <br /> (1) All equipment shall have sound control devices no less effective than those <br /> provided on the original equipment. No equipment shall have exhaust systems <br /> without muffiers. <br /> (2) No piledriving activities shall be performed within 3,000 feet of an occupied <br /> dwelling unit between the hours of 7:00 p.m. and 7:00 a.m. No blasting <br /> operations shall be permitted as a part of this approval. <br /> Conditions of Approval -8 - QX-91-5 <br /> I <br />
