r r <br /> V. A Landscaping/Screening Plan shall be submitted to the Director for approval prior to <br /> initiation of the approved excavation. The Plan shall be consistent with the Landscape <br /> Plan in the Quarry Excavation application and indicate the following: <br /> (1) The landscaped berms on Blewett Road and Bird Road and other means of visual <br /> screening for the processing plant shall be installed during the first fall planting <br /> period following approval of the application and prior to the initiation of the use ' <br /> of the plant. <br /> (2) The processing plant shall be painted in a color to blend with the surrounding <br /> terrain. - i <br /> (3) Phase 2 of the excavation shall be screened from the view of Interstate 5 by the <br /> planting of dense evergreen shrubs between the rows of orchard trees in the 100- <br /> foot-wide buffer and shall be installed prior to the initiation of excavation of this <br /> phase. <br /> (4) Phases 6 and 7 shall be screened from the view of Interstate 5 by the planting <br /> of fast growing,tail evergreen shrubs within the 100-foot wide buffer of Interstate <br /> 5 and the 5046ot wide buffer of the California Aqueduct, and the shrubs shall be <br /> installed prior to the initiation of excavation of these phases. <br /> (5) The conveyor belt crossing over Interstate 5 and the California Aqueduct for <br /> Phases 6 and 7 shall be designed and constructed to resemble the existing <br /> overpasses on Interstate 5. As an alternative, the excavator may construct a <br /> tunnel crossing to provide visual attenuation. <br /> y, <br /> W. Operations shall be,in accordance with instructionsfrom the Agricultural Commissioner <br /> of San Joaquin County. (Development Title Section 9-1415.2{h}) <br /> X. Project personnel shall be required to wear hard hats on the site. <br /> Y- The excavator shall be required to anchor processing facilities to the ground. <br /> Z. Except as otherwise provided in Stade Mining Regulations,the County shall have authority <br /> to enforce provisions of the Surface Mining and Reclamation Act. The County may <br /> exercise all enforcement regulations available under the County Development Tale and <br /> the State Public Resources Code. Such enforcement measures include charging the <br /> applicant the costs of administering an enforcement action. The basis for charging fees <br /> for an enforcement action shall be a time and materials compensation. (Development <br /> Title Section 9-1415.2{tl) <br /> aa. Submit a Report of Waste Discharge (RWD) to the California Regional Water Quality <br /> Control Board 180 days prior to the start of any activity on the site. <br /> bb. The owner shall defend, Indemnify, and hold harmless the local agency or its agents, <br /> officers, and employees from any claim, action, or proceeding against the local agency <br /> or its agents, officers, or employees to attack, set aside, void, or annual an approval of <br /> the local agency, advisory agency, appeal board, or legislative body concerning this <br /> quarry excavation permit. <br /> Conditions of Approval -9 - QX-91-5 <br />
