Noise <br /> Pursuant to Development Title Table 9-1025.9, the Religious Assembly use type is a <br /> noise sensitive land use. The Noise Contour Map indicates that 163 feet of the southern <br /> boundary of the project site lies within the sixty-five decibel (65 dB) noise contour of <br /> Eight Mile Road (General Plan Table IIID-5B, Volume III, page III.D-38). The existing <br /> workshop building to be converted into a prayer hall is located 161 feet from the <br /> southern property line and two feet of the building lies within the noise contour line. A <br /> noise study will be required at the lime of development if a prayer hall is proposed within <br /> the noise contour line. However, because the applicant is proposing the two foot portion <br /> of the building to be utilized as a storage area, a noise study is not required at this time <br /> as the prayer hall area will not be located within the noise contour line. The applicant <br /> must present a floor plan depicting the storage area on the Improvement Plan. <br /> The application has been tentatively scheduled for the Planning Commission meeting on <br /> October 3, 2013. The Community Development Department has reviewed the Use <br /> Permit application, and providing any outstanding issues have been resolved and the <br /> submittal of a revised site plan, will recommend that the Planning Commission approve <br /> the application subject to the following Conditions of Approval: <br /> Use Permit Application No. PA-1300121 was approved by the Planning Commission <br /> on . The effective date of approval is . This approval will expire on , which is 18 <br /> months from the effective date of approval, unless (1) all Conditions of Approval <br /> have been complied with, (2) all necessary building permits have been issued and <br /> remain in force, and (3) all necessary permits from other agencies have been issued <br /> and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements <br /> shall be fulfilled prior to the establishment of the use and the issuance of any <br /> building permits. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified, and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Stephanie Stowers, <br /> (209) 468-9653) <br /> a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING <br /> PERMIT'. The Site Plan required as a part of the building permit must be prepared <br /> by a registered civil engineer or licensed architect. This Plan must show drainage, <br /> driveway access details including gates, on-site parking, landscaping, signs, <br /> existing and proposed utility services, and grading (refer to the "SITE PLAN <br /> CHECK LIST" for details). Foundation and soils investigation shall be conducted in <br /> conformance with Chapter '18 of the California Building Code at the time of permit <br /> application. A fee is required for the Site Plan review, (Development Title Section <br /> 9-884) <br /> b. APPROVED USE: This approval is for the conversion of an existing 864 square <br /> foot workshop building into a religious assembly facility for a maximum of 25 <br /> people (Use Type: Religious Assembly — Neighborhood) <br /> c. CAPITAL FACILITY FEE: This project may be subject to the Capital Facility Fee. <br /> If the Capital Facility Fee is applicable, the County shall collect the fees before the <br /> issuance of any building permits (Development Title Section 9-1245.2) <br />
