f <br /> AGREEMENT TO ABANDON NON-COMMUNITY <br /> PUBLIC WATER SYSTEM <br /> This Agreement to Abandon Non-Community Public Water System <br /> ("Agreement") is entered into this 3rd day of ,Tune 2008 by and between <br /> Sanguinetti Investments, LLC and San Joaquin County Environmental Health <br /> Department collectively referred to as the ("Parties"). <br /> Recitals <br /> WHEREAS, Sanguinetti Investments, LLC ("Sanguinetti") is the owner of that <br /> certain real property located in unincorporated Farmington commonly referred to as 4391 <br /> South Escalon Bellota Road (APN 187-130-10 & 06), and which is more particularly <br /> described in the legal description attached and incorporated herein as Exhibit"A" the <br /> ("Property"). Sanguinetti seeks to develop the Property into a service station; and <br /> WHEREAS, Sanguinetti has been working with the San Joaquin Environinentai <br /> Health Department, the ("Department") for the purposes of securing an adequate source <br /> of potable water to serve the Property and which meets the Department's requirements <br /> for water quantity and quality under the California Safe Drinking Water Act; and <br /> WHEREAS, the Department has advised Sanguinetti that the Farmington Water <br /> Company has applied for and meets the criteria for State Revolving Fund ("SRF") money <br /> for replacement wells and distribution system improvements, which would allow for that <br /> public water system to serve the Property. The Parties acknowledge that the specific <br /> timeline for this occurring is unknown. The Department has indicated that the most <br /> viable alternative at this time is for Sanguinetti to install a temporary public water system <br /> well on the Property. Since this well would be serving at least twenty-five (25) or more <br /> individuals at least sixty (60) days out of the year, the Department has advised that it <br /> would meet the definition of Transient Non-Community Public Water System <br /> ("TNPCWS"). Sanguinetti is working with its engineer, and County Staff to design a <br /> TNPCWS well which meets the Department's applicable criteria and requirements. <br /> WHEREFORE, the Parties agree as follows: <br /> I <br /> AGREEMENT TO ABANDON NON-COMMUNITY PUBLIC WATER SYSTEM <br />
