1. Incorporation of Recitals. The Parties confirm and acknowledge that the <br /> above Recitals are true and correct and incorporated herein. <br /> 2. Agreement to Abandon the TNPCWS. Sanguinetti agrees and stipulates, <br /> as a condition to approval of a TNPCWS on the Property, at such time as the Farmington <br /> Water Company has a reliable source of potable water that meets the quantity and quality <br /> standards of the California Safe Drinking Water Act, the Department may require that the <br /> Property be connected to the Farmington Water Company Public Water System and the <br /> TNPCWS well existing on the Property be destroyed under permit and inspection of the <br /> Department.
