Recommendations Action It is recommended that the Planning Commission: 1. Approve the Negative Declaration; and 2. Approve Use Permit No. PA-1100059 with the Findings and Conditions of Approval contained in the staff report. Findings l The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any applicable Master Plan, Specific Plan.. and Special Purpose Plan, and any other applicable plan adopted by the County. • This Finding can be made because the establishment, maintenance and operation of a communications tower do not conflict with the General Plan. The use proposed in application PA1100059 is consistent with the Rural Residential General Plan designation, which in turn is permitted in the Rural Residential zone. There are no applicable Master Plans, Specific Plans, or Special Purpose Plans in the vicinity. l_. Adequate utilities.. roadway improvements, sanitation, water supply, drainage, and other necessary facilities have been provided, and the proposed improvements are properly related to existing and proposed roadways. • This Finding can be made because adequate utilities, access roads, sanitation, drainage and other necessary facilities will be provided and the proposed improvements are properly related to existing and proposed streets and highways. This project does not need public sewer or water. Any additional storm water drainage will be contained on site. The site is physically suitabic for the type of development and for the intensity of development • This Finding can be made because the 0.97-acre property involved is of adequate size and shape to accommodate the proposed communications tower and all yards, building coverage, setbacks, parking areas and other requirements of this Title. The tower will be a minimum of the height of the tower(149 feet) from any residence on any adjacent parcel. The tower will meet FCC and FAA requirements. 4. Issuance of the permit will riot be significantly detrimental to the public health, safety, or welfare, or be injurious to the property or improvements of adjacent properties. • This Finding can be made because an Initial Study prepared for this project found no potentially significant environmental impacts that could not be mitigated to a level of less than significant. 5. The use is compatible with adjoining land uses. This Finding can be made because with the Conditions of Approval the communications tower will not interfere with or alter the current commercial and residential uses on adjacent properties.
