Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit No. PA-1100059 with the Findings and Conditions of Approval contained in <br /> the staff report. <br /> Findings <br /> l The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan.. and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because the establishment, maintenance and operation of a <br /> communications tower do not conflict with the General Plan. The use proposed in <br /> application PA1100059 is consistent with the Rural Residential General Plan designation, <br /> which in turn is permitted in the Rural Residential zone. There are no applicable Master <br /> Plans, Specific Plans, or Special Purpose Plans in the vicinity. <br /> l_. Adequate utilities.. roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This Finding can be made because adequate utilities, access roads, sanitation, drainage <br /> and other necessary facilities will be provided and the proposed improvements are <br /> properly related to existing and proposed streets and highways. This project does not <br /> need public sewer or water. Any additional storm water drainage will be contained on site. <br /> The site is physically suitabic for the type of development and for the intensity of development <br /> • This Finding can be made because the 0.97-acre property involved is of adequate size and <br /> shape to accommodate the proposed communications tower and all yards, building <br /> coverage, setbacks, parking areas and other requirements of this Title. The tower will be a <br /> minimum of the height of the tower(149 feet) from any residence on any adjacent parcel. <br /> The tower will meet FCC and FAA requirements. <br /> 4. Issuance of the permit will riot be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This Finding can be made because an Initial Study prepared for this project found no <br /> potentially significant environmental impacts that could not be mitigated to a level of less <br /> than significant. <br /> 5.
