(CIO DILLON & <br /> MURPHY) (10663 N ST RT 88 HY, STOCKTON)(APN: 063-110- <br /> 15) <br /> The applicant has submitted the above referenced application to cancel 1.44 <br /> acres of Williamson Act Contract No. 73-C1-65 to facilitate a Lot Line <br /> Adjustment. The parcel has a General Plan Designation of (A/G) General <br /> Agricultureand is zoned (AG-40) General Agriculture, 40-acre minimum. On site <br /> uses include a single family residence and an agricultural building. The eastern <br /> property line abuts North State Route Highway 88. The northern property line <br /> abuts East Bay Municipal Utility District Mokelumne Aqueduct. The southern <br /> property line is adjacent to agricultural lands. The project site is located on the <br /> west side of State Route Highway 88, 2,500 feet north of Eight Mile Road, North <br /> of Stockton. <br /> On December 26, 1972 California Land Conservation Contract No. 73-C1-65 was <br /> initiated for Assessor's Parcel Numbers 063-110-15 and 063-110-14. The <br /> Community Development Department approved a Notice of Nonrenewal for a <br /> portion of contract No. 73-C1-65 containing 91.24 acres on July 5, 2007. The <br /> purpose of the cancellation is to separate the home and agricultural building on <br /> the parcel by adjusting the line with the parcel to the north (APN: 063-110-14). <br /> The resultant parcels would contain 170.95 acres and 1.44 acres. <br /> Notification <br /> Pursuant to Government Code Section 51284.1, the county must submit a notice <br /> to the Department of Conservation and consider its comments prior to approving <br /> a tentative Williamson Act contract cancellation. The notice must include a copy <br /> of the application, a copy of the contract, a description of the land, and a deadline <br /> for submitting comments. Such notice was mailed to the Department of <br /> Conservation on December 21, 2007. <br /> 1 <br />
