IL <br /> k 1 # f 1 <br /> Environmental Considerations <br /> The initial study prepared for this project on January 13, 2008 concluded that the <br /> proposed cancellation would not result in any significant environmental impacts. <br /> Based on the initial study, a negative declaration was prepared and forwarded to <br /> the State Clearinghouse and Planning Unit for circulation. <br /> Canceliation Value and Cancellation Fees <br /> The County Assessor is responsible for computing a cancellation fee for.the <br /> subject property based on 12 '/z percent of the current market value. The <br /> Assessors office has indicated that the computed fee will be $37,500.00. <br /> Findings <br /> The Board of Supervisors may grant tentative approval for cancellation of a <br /> contract on Williamson Act property only if it makes one of the following findings: <br /> 1. That the cancellation is consistent with the purposes of the Williamson <br /> Act; or <br /> 2. That the cancellation is in the public interest. <br /> Both of these findings include subfindings that the Board must also make. The <br /> following is an analysis of those findings. <br /> 1. That the cancellation is consistent with the purposes of the Williamson <br /> Act. <br /> a. The cancellation is for land on which a Notice of Nonrenewal has been <br /> served pursuant to Section 51245 of the Government Code. <br /> This subfinding can be made because the Community <br /> Development Department approved a Notice of Nonrenewal on <br /> July 5, 2007. <br /> b. The cancellation is not likely to result in the removal of adjacent lands <br /> from agricultural use. <br /> This subfinding cannot be made because approval of this <br /> cancellation request would likely result in requests for additional <br /> single family residences on adjacent agricultural properties which <br /> would remove the property under and immediately around the <br /> residences from agriculture. For example, the 31.96 acre property <br /> adjacent to this site and to the south is under a Williamson Act <br /> Contract and is a non-conforming parcel because it does not <br /> meet the zone minimum for the AG-40 zone as to size. The parcel <br /> adjacent to this 31.96 acre parcel contains 69.40 acres and is a <br /> conforming parcel for the AG-40 zoning designation. <br /> 2 <br />
