r <br /> If a house were built on the 31.96 acre parcel the owner could <br /> then configure a lot, with a lot line adjustment of the same size of <br /> the present request for cancellation. A similar procedure could <br /> be used to result in many additional houses being built on land <br /> under, Williamson Act Contract throughout San Joaquin County. <br /> C. The cancellation is for an alternative use which is consistent with the <br /> applicable provisions of the County General Plan. <br /> This subfinding can be made because a single-family residence <br /> and an agricultural building are permitted uses in the AG-40 zone, <br /> and are consistent with the AIG (General Agriculture) General <br /> Plays Designation. <br /> d. The cancellation will not result in discontiguous patterns of urban <br /> development. <br /> This subfinding can be made because this cancellation will not <br /> result in, or encourage, urban development. <br /> e. There is no proximate noncontracted land which is both available and <br /> suitable for the use which is proposed the contracted land be put, or, <br /> development of the contracted land would provide more contiguous <br /> patterns of urban development than development of proximate non- <br /> contracted land. <br /> This subfinding can be made because a residence and <br /> agricultural building exist on the parcel and are on <br /> property under contract. <br /> 2. The cancellation is in the public interest because: <br /> a. Other public concerns substantially outweigh the objectives of the <br /> Williamson Act. <br /> This subfinding cannot be made because this cancellation does <br /> not promote any public concerns. <br /> b. There is no proximate noncontracted land which is both available and <br /> suitable for the use to which it is proposed the contracted land be put, or, <br /> development of the contracted land would provide more contiguous <br /> patterns of urban development than development of proximate <br /> noncontracted land. <br /> This subfinding can be made because a residence and agricultural <br /> building exist and are on property under contract. <br /> 3 <br />
