<br /> ➢ A report containing results of the soil suitability and nitrate loading studies,percolation test
<br /> findings and design of an on-site wastewater disposal system(septic system)was submitted to the
<br /> EHD by Chesney Consulting on January 22, 2003. Based on the site soil characteristics,
<br /> proposed business operations and analysis of wastewater obtained from your present business
<br /> location,the septic system was designed to accommodate an average of 12 employees(7 to 25 at
<br /> current facility)and 25 customers(10 to 40 anticipated)per day. The report stated that foods and
<br /> food by-products used in the chocolate making process "will not be introduced into the septic
<br /> system"and will be handled as solid waste and disposed of in a dumpster. "...The wastewater
<br /> flow will be predominantly blackwater from toilets, with a comparatively small volume of
<br /> graywater from sinks, or other sources of graywoter. Additional wastewater constituents may
<br /> consist of coffee,juices or other similar type liquids..." The designed septic system called for a .
<br /> grease trap; primary one-compartment septic tank; secondary dual-compartment septic tank with
<br /> dual pump vault,alarm and effluent filters; a 1,800 sq. ft. filter bed and two 40-ft.leach lines with
<br /> two 36 in.diameter seepage pits 4 The report also recommended a reserve disposal field area
<br /> totaling 10,500 sq. ft. (3,500 sq. ft. for 100%replacement of initial system; 3,500 sq. ft. for a
<br /> future building proposed for future production expansion with a 3,500 sq. ft. replacement area).
<br /> The report"Conclusions and Recommendations" stressed that ... "water usage be kept to an
<br /> absolute minimum"and ... "water usage accounting will be important."s
<br /> ➢ In a letter to the CVRWQCB,dated March 1, 2003,Chesney Consulting submitted inform tion
<br /> requested in that agency's October 21, 2002, letter,along with a wastewater discharge permit fee
<br /> of$400.00.
<br /> On March 5,2003,EHD staff began review of the soil suitability and nitrate loading studies
<br /> submitted by Chesney Consulting.
<br /> On April 15,2003,approval of the plot plan for your project was requested at the EHD public
<br /> counter. The plot plan presented was for a new 19,826 sq. ft.building,a 1,600 sq. ft. filter bed,
<br /> and septic tanks located in the access area north of the building. The new building size
<br /> represented a 57.3%increase in the size over the original 12,600 sq. ft. building described in the
<br /> site approval application. The plot plan also showed two additional restrooms and a private
<br /> restroom with shower on the second floor. The equipment shown included two water-cooled
<br /> tables in the production area. The.EHD approved the plot plan for"Plan Check Only"which
<br /> allowed the CDD to begin their plan check process prior to issuance of building permits.
<br /> On April 17 and April 22, 2003,the EHD received telefaxed copies of correspondence from you
<br /> to Tim O'Brien at the CVRWQCB concerning wastewater flow associated with the production
<br /> portion of your operation. You proposed to discharge water from the water-cooled tables to the
<br /> storm drain and reiterated that The chocolate
<br /> manufacturing area uses virtually
<br /> no water"with
<br /> "only occasional washing of molds and hand tools in that area.' .
<br /> ➢ On April 29,2003,your telefaxed letter was received requesting confirmation that the EHD Site
<br /> Approval conditions had been met so grading and building permits could be issued by the CDD.
<br /> In this letter,you also commented on verbal discussions between you and my staff,and the
<br /> additional information requested by the EHD following review of the plot plan submitted on
<br /> April 15`x.
<br /> ➢ In a letter dated April 30,2003, the EHD approved the Nitrate Loading Study submitted by
<br /> Chesney Consulting with six conditions listed. Condition#I specified that, prior to EHD
<br /> approval for the issuance of grading permits,an enlarged drawing to scale of the proposed
