TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> (1) The homesite shall not be transferred until August 16, 2020, or upon the death of an owner <br /> owning at least fifty(50) percent interest in the homesite parcel, unless the homesite parcel and <br /> the remainder parcel are merged pursuant to the provisions of the Development Title. <br /> (2) The property shown on the Parcel Map is restricted from further subdivision for homesite <br /> purposes';except for financing only, by Section 9-610.3 of the San Joaquin County Development <br /> Title. <br /> g. RIPARIAN HABITAT: Parallel to Dry Creek along Parcel one and the Designated Remainder <br /> parcel, a natural open space area for riparian habitat and waterway protection shall be <br /> maintained to provide nesting and foraging habitat and the protection of waterway quality. The <br /> minimum width of said open space shall be one-hundred (100) feet, measured from the mean <br /> high water level of the natural bank or. fifty (50) feet back from the existing riparian habitat, <br /> whichever is`greater. a�dependent uses may be permitted im-this buffer. The mean-high <br /> water level and the edge of the riparian habitat shall be shown on the Parcel Map. The open <br /> space buffer tpquired above shall be shown on the Parcel Map with the following dote: <br /> (1) Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space 'for riparian habitat and waterway protection. No <br /> development other than water dependent uses shall be permitted in this space. <br /> h. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) A proposed 25-foot wide private easement for access to Parcel 2 along the Designated <br /> Remainder parcel shall be shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> (2) The following note shall be placed on the Parcel Map and also shall be recorded as a separate <br /> instrument: <br /> A. At the time of non-agricultural development of Parcel 2, the entire length of the private <br /> right-of-way for the parcel shall be constructed and maintained to the standards required <br /> by the California Fire Code and applicable San Joaquin County Improvement Standards. <br /> (Development Title Section 9-1150.15[c]) <br /> 2. COUNTY COUNSEL <br /> a.
