Analysis <br /> Background <br /> On November 17, 2002, Major Subdivision Application No. PA-0200098 was approved by the Planning <br /> Commission. <br /> On November 17, 2005, a five-year Time Extension was approved by the Planning Commission. <br /> Development Title Section 9-310.5(b) is a discretionary provision in the Development Title regarding <br /> setbacks that must be requested as part of the subdivision application (or as part of a Revisions of <br /> Approved Actions application). There was no request to incorporate the provision submitted with the <br /> application. The applicant needs the provision added because several of the corner lots will not <br /> accommodate any of the four single-family residences designed for this subdivision. <br /> The Site Plan submitted with the Revisions of Approved Actions application is not intended to be a new <br /> tentative map. The Site Plan is for the identification of the applicable corner lots only. This Revisions of <br /> Approved Actions does not revise the approved tentative map. <br /> Setbacks <br /> Development Title Section 9-310.5(b) states that for Major or Minor Subdivision applications, one or more <br /> required yards may be reduced for individual lots provided the following conditions are met: <br /> • The sum of the dimensions of the side yard and street side yard must be equal to or greater than <br /> the sum of the dimensions of the side yard and street side yard required by Table 9-310.3. <br /> (Section 9-310.5[b][41); <br /> • The street side yard is not less than ten (10)feet in width. (Section 9-310.5[b]13]); <br /> The setback for the street side yard in the R-L zone is twenty (20) feet and the side yard setback is five <br /> (5)feet. Therefore, the total setback for the side yard and street side yard is twenty-five (25) feet. If the <br /> Revisions of Approved Actions is approved, then the street side yard setback will be a minimum of ten <br /> (10)feet in width and the total average minimum setback for the side and street side yard of the corner <br /> lots highlighted on the site plan will be twenty-five (25)feet in width. <br /> To ensure future compliance with the Development Title, the required setbacks for each lot will be the <br /> setbacks shown on the individual plat maps included with this application and used for the calculation of <br /> the average total setback of twenty-five (25) feet.
