Analysis <br /> Background <br /> On November 19, 1987, Use Permit No. UP-88-0008 was approved to permit a group care facility for up <br /> to 12 children. On November 22, 2002, a Revisions of Approved Actions application was approved to <br /> change the approval from 12 children to 12 adult residents. The applicant has an approved business <br /> license (BL-0700104) to operate a group care facility for a maximum of 12 adult residents. The group care <br /> facility is currently conducted within an existing 4,438 square foot residence. This Use Permit proposes <br /> an expansion of an existing group care home from 12 residents up to a maximum of 21 residents. The <br /> proposed expansion from 12 residents to 21 residents will utilize the existing dwelling; no further <br /> expansion of the dwelling is currently being proposed. The group care home employees will work ten- <br /> hour shifts within a 24-hour period and will not reside on the premises. <br /> Public Service Access <br /> Development Title Section 9-1030.3(f) states that the applicant must develop and implement a public <br /> service access plan providing or arranging for transportation, as necessary, for group care residents. The <br /> plan must specifically describe the means by which residents will gain access to bus and other public <br /> transportation routes, shopping locations, medical, dental, or other health care facilities, and government <br /> offices. This plan will be required as a Condition of Approval and must be approved by the Community <br /> Development Department. <br /> Outdoor Recreation Area <br /> Development Title Section 9-1030.3(a) states that an exterior yard area is a requirement for a social care <br /> facility. The exterior yard area must consist of an outdoor recreation area. (Development Title Section 9- <br /> 1030.3[b])The outdoor recreation area must be a minimum of seventy-five (75) square feet per user over <br /> two (2) years of age. With the project proposing up to 21 residents, the requirement for an outdoor <br /> recreation area would be 1,575 square feet. The existing rear yard area is 10,000 square feet and will be <br /> used as the required outdoor recreation area. Furthermore, outdoor activities will be limited to the hours <br /> of 7 a.m. to 10 p.m. <br /> All outdoor recreation areas must be enclosed by walls or fences not less than six (6) feet in height. <br /> (Development Title Section 9-1030.3[c])The outdoor recreation area is currently fenced with a masonry <br /> wall, a six-foot high solid wooden fence, and a six-foot high chain link fence and therefore meets the <br /> fencing requirement. <br /> Pro[ect Opponents <br /> The Community Development Department has received a petition in opposition signed by 34 neighbors. <br /> The petition expressed concerns regarding the compatibility of a group care home within a residential <br /> neighborhood and the location of a group care home in relation to the nearby commercial land uses and <br /> elementary school. <br /> In response, the group care home is consistent with the requirements, regulations and policies of the <br /> Development Title regarding both the R-L zone (Low Density Residential) and large group care homes.
