Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Use Permit Application No. PA-0800214 with the Findings and Conditions of Approval
contained in the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any
applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because the residential use type Group Care-Large may be
conditionally permitted in the R-L zone (Low Density Residential) with an approved Use
Permit application. The parcel is zoned R-L and has a General Plan designation of R/L (Low
Density Residential). The R-L zone is an implementation zone of the R/L General Plan
designation. The project site is within a residentially developed area and is located within
the urban community of Stockton. There are no applicable Master Plans, Specific Plans,
Special Purpose Plans, or any other applicable plans within the vicinity of this project.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This finding can be made because the applicant has provided will-serve letters from
California Water for public water and the Department of Public Works for public sewer. The
Department of Public Works has determined that the proposed project will not have any
impact on the existing storm drainage system and will continue to be served by County
Service Area 54.
3. The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because the 0.48-acre parcel is of adequate size and shape to
accommodate the group care facility and all yards, building coverage, setbacks and other
requirements of the Development Title. The group care home will utilize the existing 4,438
square foot residence and an existing 552-square-foot building for a recreation room. The
existing dwelling is of adequate size to accommodate the proposed number of residents.
The lot size is adequate to accommodate the required outdoor recreation areas.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties
• This finding can be made because the Initial Study prepared for the project found no
potentially significant environmental impacts.
San Joaquin County PA-0800214/Meredith
— Community Development Page 4
