F <br /> CONDITIONS OF APPROVAL <br /> r SA-99-82 <br /> Benny's Spray Center <br /> l <br /> Site Approval Application No. SA-99-82 was approved by the San Joaquin County Community <br /> Development Department on December 6, 1999. The effective date of approval is December 16, <br /> 1999. This approval will expire on June 16, 2001, which is 18 months from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building <br /> permits have been secured and remain in force, and (3) all necessary permits from other agencies <br /> have been secured and iemain in force. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ord inance"requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Kai Luoma,468-9567) <br /> I <br /> a. BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT." The Site <br /> Plan required as{'a part of the building permit must be prepared by a registered civil engineer or <br /> licensed architect'. This Plan must show drainage,driveway access details(including gates),on-site <br /> parking, landscaping, signs, existing and proposed utility services, and grading (refer to the "SITE <br /> PLAN CHECK LIST' for details). A fee is required for the Site Plan review. (Development Title <br /> Section 9-884) <br /> b. APPROVED USE: This approval is for the enclosure of an existing shed to include construction of <br /> individual spacesifor storage and vehicle parking, and for the construction of a 3,500-square-foot <br /> building for the expansion of an existing business that sells, services, and rents sprayers and <br /> pressure equipment (use type — construction services light) as shown on the Plan submitted <br /> October 13, 1999; <br /> c. BUSINESS LICENSE: The applicant shall secure an approved Business License prior to the <br /> initiation of the use. The Business License may be applied for concurrently with the building permit <br /> application. (Section 7-1000 of the County Ordinance Code) <br /> i <br /> d. SETBACKS: The following setbacks apply: <br /> I <br /> (1) If a side yard abuts a property developed residentially, said side yard shall be increased to <br /> twenty (20) feet in depth. The proposed building must be set back a minimum of twenty feet <br /> from the existing residential parcel to the east. (Development Title Section 9.410.5[b]) <br /> e. PARKING: Off-street parking shall be provided and comply with the following: <br /> (1) All parking spaces, driveways, and maneuvering areas shall be surfaced and permanently <br /> maintained with base material of appropriate depth and asphalt concrete or Portland cement <br /> concrete to provide a durable, dust-free surface. Bumper guards shall be provided where <br /> necessary to protect adjacent structures or properties. (DevelopmentTitle Section 9-1015.5[e]) <br /> (2) An additional eight (8) parking spaces shall be provided, for a minimum of thirty (30) spaces <br /> total, including one (1)van accessible space(parking requirements for construction services are <br /> 1/1,000squar.'e.feet).
