Analysis <br /> Background <br /> This is the site of the former Atlanta School. The four-acre site is now an orchard and single-family <br /> residence with several detached structures, including a detached garage, a guesthouse, and an attached <br /> garage that is to be converted into a neighborhood church. This application was initiated because of an <br /> open enforcement action. There was a 2500-square-foot tent near the front of the property that was being <br /> used for church activities without benefit of the necessary permits. The activities included amplified music <br /> and speech. The tent and amplification equipment have been removed and are not part of this permit. <br /> Neighborhood Opposition <br /> The Community Development Department has received eight letters of opposition. The letters expressed <br /> concerns regarding allowable uses, safety, noise, ground water contamination, traffic, degradation of <br /> property values, air quality, building code violations, and fire code violations. <br /> Permitted Use <br /> Religious Assembly may be permitted in the General Agriculture zone with an approved Use Permit. <br /> Approval of the application would not change the zoning of the parcel. <br /> Safe <br /> The regular gathering of 35 people for religious assembly is not expected to create a safety hazard. The <br /> California Highway Patrol and the San Joaquin County Sheriffs Department were both notified of this <br /> project. Neither agency responded. <br /> Noise <br /> The Initial Study identified noise as a less than significant effect. The use connected with this permit will be <br /> conducted entirely indoors. All uses and property must comply with the Development Title Noise Ordinance <br /> Section 9-1025.9. This will ensure that noise levels will be less than significant. <br /> Groundwater Contamination <br /> This application was sent to the Environmental Health Department for review. The Environmental Health <br /> Department has recommended several Conditions of Approval that will reduce the groundwater <br /> contamination impact to less than significant. Condition A requires that a soil suitability/ nitrate loading study <br /> be conducted which indicates that the area is suitable for septic tank usage. Condition B requires testing of <br /> the individual private water wells. Condition C requires the construction of individual sewage disposal <br /> systems under permit and inspection by the department. Condition D requires the construction of a water <br /> well. <br /> Traffic <br /> This application was referred to the Department of Public Works for review. The Department of Public <br /> Works did not require any changes to the roadway, nor did they require preparation of a traffic study. The <br /> applicants will be required to pay a Traffic Impact Mitigation Fee.
