Aesthetics <br /> This project will not change the appearance of the neighborhood. It will not obstruct any public scenic vista <br /> or view, create an aesthetically offensive site open to public view, or produce light or glare. Therefore, the <br /> aesthetic impact to the neighborhood will be less than significant. <br /> Air Quality <br /> The Initial Study found the change in air quality to be less than significant. The project was referred to the <br /> San Joaquin Valley Air Pollution Control District. The District also found that this project will have less than <br /> significant impact on the ambient air quality. There will be no conditions related to air quality assigned to this <br /> project. <br /> Building and Fire Code Violations <br /> Building and fire code violations are enforced through the permitting process and through customer service <br /> complaints. There have been no code violations reported to the Enforcement Division. Any violations <br /> discovered as part of this application will be enforced. <br /> Bonfires <br /> Bonfires are not part of this permit. An open air bum permit from the San Joaquin Valley Unified Air <br /> Pollution Control District is required for any recreational burning. <br /> Future Expansion <br /> Pursuant to Section 9-821.5, a use may be expanded by 25%of its building square footage or 10%of the <br /> total project size without obtaining a new Use Permit. Any significant expansion of the religious assembly <br /> use would require a new land use permit. <br /> Other Uses <br /> A ninth letter was received that notifies the Community Development Department of the close proximity of <br /> their farming operations. The letter indicates that"the normal scope of farming practices includes spraying <br /> by ground and helicopter. It is possible that some spraying will be done on weekends. In addition, dust is an <br /> inevitable part of farming and this may be an issue for a neighborhood church." <br /> San Joaquin County has a right-to-farm ordinance. Section 6-9000 of the Ordinance Code of San Joaquin <br /> County declares that no agricultural activity, operation, or facility, or appurtenances thereof, conducted or <br /> maintained for commercial purposes, and in a manner consistent with proper and accepted customs and <br /> standards as established and followed by similar agricultural operations in the same locality, shall be or <br /> become a nuisance, private or public, due to any changed condition in or about the locality, after the same <br /> has been in operation for more than three years if it was not a nuisance at the time it began.
