Recommendations Action It is recommended that the Planning Commission: 1. Approve the Negative Declaration; and 2. Approve Use Permit Application No. PA-0400206 with the Findings and Conditions of Approval contained in the staff report. Findings 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any applicable Master Plan, Specific Plan, and Special Purpose Plan: and any other applicable plan adopted by the County. • This finding can be made because Religious Assembly is allowed in the AG-40 zone (General Agriculture-40 acre minimum lot size for new lots) with an approved Use Permit. The AG-40 zone is an implementing zone of the General Agriculture designation of the General Plan. There are no other applicable Master Plans, Specific Plans, Special Purpose Plans, nor other applicable plans adopted by the County. 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary facilities have been provided, and the proposed improvements are properly related to existing and proposed roadways. • This finding can be made because adequate utilities, roadway improvements, and drainage already exist for the proposed use. A soil suitability/nitrate loading study will be performed before a building permit is issued to ensure that adequate sanitation and water supply facilities can be provided. These improvements are, or will be, properly related to existing and proposed roadways. 3. The site is physically suitable for the type of development and for the intensity of development. • This finding can be made because the project site is a flat, four-acre parcel that contains a single-family residence and an orchard. A meeting room for 35 people, a 12-car parking area, and all other Conditions of Approval can be accommodated within the project area. 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be injurious to the property or improvements of adjacent properties. • This finding can be made because the conditions regarding the septic system, well, parking, and other Conditions of Approval associated with this project ensure that the issuance of a permit will not be significantly detrimental to the public health, safety, or welfare or be injurious to the property or improvements of adjacent properties.
