Inc. <br /> 8452 DeMartini Lane <br /> Linden, CA 95236 <br /> REQUEST FOR REPORT OF WASTE DISCHARGE, LINDEN NUT COMPANY, INC., SAN <br /> JOAQUIN COUNTY <br /> We understand that you recently purchased Linden Nut Company and are currently discharging <br /> or planning to discharge food processing wastewater onsite. The previous owner had been <br /> discharging wastewater to an unlined pond at the facility without regulation under Waste <br /> Discharge Requirements (WDRs), a permit that is required under the California Water Code. <br /> In October 2010, the previous owner of Linden Nut Company, Inc., submitted a Report Waste <br /> Discharge (RWD) to obtain WDRs. However, the RWD did not contain enough information <br /> needed to develop WDRs and the previous owner did not submit an RWD addendum requested <br /> in the 27 September 2012 RWD Incomplete letter (see Attachment A). On 15 May 2013. the <br /> Executive Officer of the Central Valley Water Board ordered Linden Nut Company to submit the <br /> previously requested RWD addendum by 30 July 2013 (see Attachment B). Due to the <br /> ownership change, the Central Valley Water Board requires you to submit a new RWD to apply <br /> for WDRs prior to any expansion of the current operation. <br /> Based on your website, we understand that you are planning to increase production at the <br /> Linden Nut facility The RWD submitted by the previous owner may not describe your planned <br /> expansion Therefore, you must submit a complete RWD on your own. If you intend to use the <br /> previously submitted RWD, you must submit a completed and signed Form 200 (attached) that <br /> expressly states that the previously submitted RWD Technical Report completely describes your <br /> operation and any actual and planned discharges, as well as the information required to <br /> complete the RWD as defined in our letter of 27 September 2012 to the previous <br /> owners. You may not discharge any waste until Waste Discharge Requirements are adopted, <br /> except as might be allowed under California Water Code section 13264. <br /> The permit process begins with submittal of a RWD with the applicable filing fee (which will <br /> serves as the first annual fee) and the required technical information. Once the RWD is <br /> determined to be complete, we will schedule permit development. The permitting process <br /> includes a 30-day public review of draft (tentative) WDRs and a public hearing by the Central <br /> Valley Water Board.
