PA-0600186 OF HUMBERTO <br /> PANIAGUA (APN: 119-210-32; ADDRESS: 1960 GILCHRIST AVENUE, <br /> STOCKTON) <br /> This project is a non-conforming cabinet shop that will replace a non-conforming truck <br /> repair facility in a residential zone. (Use Type: Construction Services-Light) The truck <br /> repair facility was located on the project parcel and the adjacent parcel to the south. The <br /> cabinet shop is a 1600 square foot detached wood building that is located in the <br /> northeast corner of the site. The General Plan designation is Low Density Residential <br /> (R/L) and the zoning is Low Density Residential (R-L). <br /> This project is located on the east side of Gilchrist Avenue, 400 feet north of Waterloo <br /> Road, east of Stockton. <br /> Sewer Main Unit <br /> A change of use from a truck repair facility to a cabinet shop requires a change of <br /> occupancy from S1 to F3 to meet building code requirements. This change requires that <br /> new restrooms be installed. However, the Department of Public Works indicates that no <br /> sewer main units are available for this property. The Department of Public Works, in <br /> their memo dated May 1, 2006, is recommending denial based on the inability to <br /> obtain an additional sewer unit. The Community Development Department will <br /> deny this application unless this issue can be resolved. <br /> Non-conforming Use <br /> Development Title Section 9-235.3(c)(2) states that a non-conforming use conducted <br /> wholly or partially within a structure may be changed to another nonconforming use <br /> within said structure subject to an approved Site Approval application. The Community <br /> Development Director must find that the proposed use is less detrimental to, or will have <br /> no greater impact in, the zone than the existing non-conforming use. In permitting such <br /> change, conditions, safeguards, and an amortization period for the new use may be <br /> required. (Development Title Section 9-235.3[c][3]) <br />
