Growers cultivating lands near or <br /> adjacent to urban development can be expected to comply with all necessary federal, state,and local restrictions <br /> regarding buffers between pesticidelherbicide applications and sensitive areas, such as schools,residences,and <br /> parks.Required buffer distances may vary,depending on the type of chemicals used and the method of <br /> application. <br /> San Joaquin County Multi-Species Habitat Conservation and Open Space Plan <br /> The San Joaquin County Multi-Species Habitat Conservation and Open Space Plan(SJMSCP)provides <br /> comprehensive measures for compensation and avoidance of impacts on various biological resources and habitats, <br /> including agricultural land.One primary goal of the SJMSCP is to preserve productive agricultural land while <br /> simultaneously protecting and preserving lands with biological resources and habitat.Conservation lands under <br /> the SJMSCP are anticipated to be acquired, in large part,through the purchase of conservation easements on <br /> farmlands that would allow the landowner to retain ownership of the land and continue agricultural operations. <br /> Funds for purchasing easements are collected from project proponents through development fees calculated on an <br /> acre-by-acre basis.The fees currently range from$845 per acre to$33,802 per acre, depending on the type of <br /> easement purchased(i.e.,vernal pool,natural and agricultural lands, and multipurpose open space)(San Joaquin <br /> ` County 2000).For each acre of open space,wildlife habitat,or farmland that is converted to development,the <br /> proponent pays a fee to the San Joaquin Council of Governments(SJCOG),which administers the SJMSCP.The <br /> College Park site and off-site improvement areas in San Joaquin County are covered under the SJMSCP.The one <br /> off-site improvement location proposed in Alameda County(Grant Line Road widening from Alameda County <br /> line to I-205)is not. <br /> San Joaquin County Right-to-Farm Ordinance <br /> The San Joaquin County Right-to-Farm Ordinance was adopted to preserve,protect, and encourage the <br /> development and improvement of agricultural land in San Joaquin County for the production of food and other <br /> agricultural products.The purpose of the ordinance is to reduce the loss of the County's commercial agricultural <br /> resources by limiting the circumstances under which agricultural operations may be deemed to constitute a <br /> nuisance.Existing agricultural land(in operation for more than 1 year)may not be considered a nuisance as a <br /> .. result of subsequently changed conditions in the area,such as urbanization.Under the ordinance,building permit <br /> applicants are provided a disclosure statement regarding the Right-to-Farm Ordinance. The goal of disclosure is to <br /> inform the buyer or owner of possible irritants, such as tractor noise or odors,to prevent future nuisance <br /> complaints.All deeds for Mountain House lots, including those proposed in College Park,are to include a copy of <br /> the County's Right-to-Farm Ordinance,as required by the MHMP. <br /> Mountain House Master Plan 1994 <br /> The following sections include those portions of the MHMP that are applicable to land use and agricultural <br /> resources under the proposed project. <br /> Pre-Existing Land Uses(Section 3.2.4) <br /> Policy 3.2.4(f).
