Because the conversion of 30 acres of existing agriculturally zoned land on the Pombo property would be <br /> temporary,and because Mitigation Measure 4.2-4 above would require that the 30 acres be restored to agricultural <br /> production once the interim land disposal of treated wastewater at the Pombo property has concluded, a less-than- <br /> significant impact would occur after mitigation implementation. <br /> IMPACT Land Use and Agriculture--Conflicts with Off-Site Agricultural Operations. The proposed project would <br /> 4.2-5 not conflict with off-site agricultural operations but could potentially affect the water supply of downstream <br /> agriculture.A significant impact could occur. <br /> The project site is surrounded to the north, south, east and west by existing agricultural operations.The existing <br /> off-site agricultural operations to the north will be phased out over the next 5 to 8 years a part of the approved <br /> Specific Plan I and proposed Specific Plan B projects.Hence,the project would not conflict with existing off-site <br /> agricultural operations to the north. A less-than-significant impact would occur. <br /> The existing off-site agricultural operations,south of I-205 are passive,in that grazing is the primary agricultural <br /> activity, rather than the growing and harvesting of irrigated feed or food crops.Aerial spraying of pesticides in <br /> these southern fields is limited if it occurs at all,and these fields are buffered from the project site by 1-205. <br /> Furthermore,except for Delta College, sensitive uses (e.g.,residences,school)are not proposed in the most <br /> southwestern portion of the project site(see Figure 3-6B in Chapter 3,"Project Description').The project would <br /> be consistent with the San Joaquin County Agricultural Commission recommendations of a minimum 100-foot <br /> setback for urban uses adjacent to existing agricultural operations that rely on aerial spraying, and consistent with <br /> the recommended 200-to 400-foot setback for residential uses(the closest project residences would be <br /> approximately 700 feet from the southern edge of I-205).Existing regulations are also in place to avoid conflicts <br /> with adjacent agricultural including: <br /> ► San Joaquin County's Right to Farm Ordinance; <br /> ► San Joaquin County General Plan Resources Element Policy B(10),which requires non-agricultural uses <br /> adjacent to agricultural areas to incorporate adequate buffers to prevent conflicts with agricultural operations; <br /> MHMP Policy 3.2.4(h),which requires development in the vicinity of existing agricultural operations to use <br /> setbacks, landscape buffers,fencing, and/or walls to minimize noise and spray drift from agricultural <br /> operations and limit potential trespass onto agricultural properties; <br /> ti <br /> ► MHMP Policy 3.2.4(j),which requires notifying all buyers of the County's Right-to-Farm Ordinance and the <br /> unique adjacent agricultural uses and operations; <br /> ► MHMP Policies 43.4(g-4),which requires a minimum 100-foot landscaped setback with berms between <br /> proposed residential development and I-205;and <br /> ► MEIMP Policies 4.3.1 (a and b),which require community edge treatments that buffer the potential adverse <br /> effects of new urban development upon farmlands in the vicinity and vice-versa, and discourage access by <br /> vehicles and pedestrians to the farmlands. <br /> Based on the above,the project would not conflict with the existing agricultural operations to the south(i.e., <br /> would not restrict aerial spraying,plowing,harvesting, etc.,and would not eventually make the existing off-site <br /> agricultural uses a nuisance use to the proposed development). A less-than-significant impact would occur. <br /> The existing agricultural operations to the east,east of Mountain House Parkway,include both passive(i.e.,grazing) <br /> and active(i.e.,irrigated feed and food crops)agriculture.Aerial spraying of pesticides in these eastern fields may <br /> occur on a limited basis,although not in close proximity of Mountain House Parkway because there are existing <br /> residences on the east side of this roadway in the area of the project site.
