MHMP(Policies 43.3(a--b)governing the"eastern edge"of the MHMP),commercial uses are proposed under the <br /> College Park project along the west side of Mountain House Parkway rather than sensitive uses.Residential uses <br /> would be developed consistent with the Agricultural Commissioner's recommended 200-to 400-foot setback(the <br /> closest project residences would be approximately 650 feet from the eastern fields and buffered from these fields by <br /> Mountain House Parkway and the proposed intervening commercial uses).Existing regulations are also in place to <br /> avoid conflicts with existing agricultural operations, including Policies 4.3.3(a—b),which require the development of <br /> landscape buffers(trees)and a 32-foot building setback along Mountain House Parkway,and the regulations <br /> discussed in the previous paragraph.Based on the above,the project would not conflict with the existing off-site <br /> agricultural operations to the east.A less-than-significant impact would occur. <br /> The existing agricultural operations to the west, in Alameda County, are passive,in that grazing is the primary <br /> agricultural activity rather than the growing and harvesting of irrigated feed or food crops.Aerial spraying may — <br /> occur in these western fields on a limited basis. An urban use(i.e.,Delta College)is proposed approximately 100 <br /> feet from the eastern edge of the grazing fields, whereas residential development is proposed approximately 300 <br /> feet east of these fields.This is consistent with the San Joaquin County Agricultural Commissioner's _ <br /> recommendations of a minimum 100-foot setback from urban uses and 200-to 400-foot setback for residential <br /> uses. Regulations are in place to avoid conflicts with existing agricultural uses along the western edge.MHMP <br /> Policies 4.3.23(a,b,d,k and j) governing the"western edge"of the MHMP require that edge treatments along the <br /> west edge be designed to mitigate impacts from aerial spraying;uses directly adjacent to the fields be limited to <br /> walls, fences, earthen berms,bike lanes,pedestrian paths,landscaping, streets,utility easements,parking, storage <br /> yards, and private yards;and that a minimum 100-foot residential building setback be provided along the western <br /> edge, including along the Delta—Mendota Canal. Other regulations are discussed in the previous paragraphs. The <br /> Delta College EIR(2002)also identifies mitigation measures to ensure that development of the college would not <br /> conflict with westerly agricultural practices,as demonstrated by Mitigation Measure 4.1-1,which requires fencing <br /> and landscaping between the college and agricultural land.Based on the above,the project would not conflict <br /> with the existing off-site agricultural operations to the west.A less-than-significant impact would occur. <br /> Project development could potentially conflict with existing adjacent on-site agricultural operations until such <br /> time as these agricultural operations have been phased out. Residential uses could potentially be developed <br /> directly adjacent to existing on-site agricultural operations and would be inconsistent with San Joaquin County <br /> Agricultural Commission's setback recommendations.However, any such conditions would be temporary, lasting _ <br /> only until the existing agricultural operations are replaced by the urban uses authorized through Specific Plan H. <br /> In addition,the large parcels on the project site are owned or controlled by the developers who are among the <br /> applicants for the College Park project(i.e., GNK, LLC,InvestWest Matthews Land,Inc., SJCCCD).Therefore, <br /> no large parcels where aerial spraying and large-scale plowing and harvesting currently takes place would exist <br /> after the preliminary phases of the project. In addition,all the existing regulations discussed previously, with the <br /> exception of the edge-treatment requirements,would apply. Based on the above,the project would not conflict <br /> with the existing on-site agricultural operations over the long term. A less-than-significant impact would occur. — <br /> MHMP Policy 3.2.4(1)requires development near and adjacent to existing agricultural operations to ensure <br /> protection of agricultural water supplies.The project is bisected by two BBID irrigation canals that provide water <br /> to on-site agriculture, as well as agriculture downstream of the project site(southeast of the project site). These <br /> irrigation canals would be filled in under the proposed project. Without converting these canals to underground <br /> pipes,or finding some other solution for providing irrigation water to the downstream agriculture dependent on _ <br /> these canals for water,a significant impact would occur. <br /> Mitigation Measure 42-5: Land Use and Agricultum—Conflicts with Adjacent Agricultural Operations. <br /> Before development,the project developers shall provide for the continued provision of irrigation water to <br /> downstream agriculture reliant on the water from the canals by the installation of pipelines and other means.
