IMPACT Cultural Resources—Potential to Uncover Human Remains. Subsurface disturbances could potentially <br /> 4.6.3 uncover prehistoric Native American burials during construction.A significant impact would occur. <br /> Although no evidence for prehistoric or early historic interments was found in the project site in surface contexts, <br /> this does not preclude the existence of buried subsurface human remains. California law recognizes the need to — <br /> protect historic era and Native American human burials, skeletal remains,and items associated with Native <br /> American interments from vandalism and inadvertent destruction.The procedures for the treatment of Native <br /> American human remains are contained in California Health and Safety Code(HSC) Sections 7050.5 and 7052 <br /> and PRC Section 5097.If any human remains to be unearthed during project construction were to be Native <br /> American in origin, a significant impact would occur. <br /> Mitigation Measure 4.6-3:Cultural Resources—Potential to Uncover Human Remains.In accordance with the <br /> California Health and Safety Code,if human remains are uncovered during construction at the project site,the <br /> College Park developer or construction contractor shall immediately halt potentially damaging excavation and <br /> notify SJCCDD.The County shall,in turn, immediately notify the San Joaquin County coroner of the find.The <br /> coroner is required to examine all discoveries of human remains within 48 hours of receiving notice of a <br /> discovery on private or state lands (HSC Section 7050.5[b]). If the coroner determines that the remains are those <br /> of a Native American,he or she shall contact the Native American Heritage Commission(NAHC)by phone — <br /> within 24 hours of making that determination(HSC Section 7050[c]).Once a Most Likely Descendent(MLD)has <br /> been designated by the NAHC,the MLD,in consultation with the County,shall determine the ultimate disposition <br /> of the remains. The responsibilities of the County for acting upon notification of a discovery of Native American <br /> human remains are outlined in detail in the PRC Section 5097.9.Measures likely resulting from the above could <br /> include preservation in place and capping/avoidance,or removal and continued monitoring of ground-disturbing <br /> activities. _ <br /> Implementation of the above mitigation measure would reduce potential impacts to human remains from <br /> construction-related activities to a less-than-significant level. <br /> 4.6.5 RESIDUAL SIGNIFICANT IMPACTS <br /> No residual significant cultural resources impacts would occur with implementation of the mitigation measures <br /> identified in this section. <br /> EDAW College Park at Mountain House Specific Plan III Draft EIR <br /> Cultural Resources 4.6-22 San Joaquin County <br />
