The <br /> path shall be grade-separated where it crosses the SP tracks." — <br /> • Revise Policy e) for Objective 5 of Parks and Recreation(Appendix C)to read as follows: <br /> "e) Passive recreational uses such as bird watching,nature trails, and observation areas are normally <br /> compatible with wetlands and may be permitted adjacent to wetlands. Active recreational uses <br /> such as ballfields,paved bike trails,or other such uses shall not be located within or immediately _ <br /> adjacent to wetlands areas" <br /> The Mountain House Creek Community Park section of the Draft Master Plan,including Implementation <br /> (v)for Objectives 3 and 4 of Parks and Recreation(Appendix C), should be revised to define timing of <br /> the creek restoration component of the park plans during the specific plan phase. Implementation(v) <br /> should indicate that: <br /> "v) All channel modifications,wetland enhancement, and revegetation associated with the Creek <br /> restoration component of the park plans shall be funded and implemented as backbone <br /> improvements during the specific plan phase and not deferred as a requirement of individual _ <br /> Tentative Map or phased flood control improvements along the Creek corridor." <br /> (b) All exhibits depicting the creek corridor in the Draft Master Plan should be modified to show a single _ <br /> multi-use path,possible alternating from one to the other side of the corridor as it follows the length of the <br /> creek(and should include provisions for access for maintenance vehicles). This should include Figures <br /> 7.4 and 7.5 referred to in Implementations(b),(g),and(p)for Objectives 3 and 4 of Parks and Recreation <br /> (Appendix Q. <br /> • Mitigation Measure M4.11-6 <br /> The Draft Master Plan provisions regarding Wetlands Management should be revised to ensure adequate <br /> setbacks from wetlands and coordination with jurisdictional agencies. This should include the following: <br /> • Revise Policy d)for Objective 5 of Biological Resources Management(Appendix C)to read as <br /> follows: <br /> "d) Wetlands shall be protected from damage caused by adjoining development. Buildings and <br /> structures shall be setback from the edge of wetlands a minimum of 50 feet. This setback <br /> distance should be increased where wetlands are of high value, or restoration and enhancement is <br /> proposed." — <br /> The following should be included as an additional Implementation for Objective 5 of Biological <br /> Resources(Appendix C): — <br /> "j) Any proposed modifications to wetlands or waters of the U.S. should be prepared in consultation <br /> with and meet,where required,with the approval of representatives of the Corps and the DFG _ <br /> prior to approval of any specific plans encompassing these features." <br /> • Mitigation Measure M4.11-7 _ <br /> (a) To ensure adequate protection of the aquatic habitat of Old River,the following should be included as an <br /> additional policy for Objective 9 of Parks and Recreation(Appendix C): <br /> "d) Unless detailed study demonstrates that the potential impacts of the proposed marina on biotic <br /> resources could be mitigated to a less-than-significant level,the proposed 60-acre marina shall be <br /> EDAW College Park at Mountain House Specific Plan III Draft EIR <br /> Biological Resources 4.10-24 San Joaquin County <br />
