4.13.2 REGULATORY SETTING <br /> FEDERAL REGULATIONS <br /> There are no federal noise regulations directly applicable to the proposed project. <br /> STATE REGULATIONS <br /> Title 24,Part 2,of the California State Building Code establishes noise standards for all new multifamily <br /> residential units.Where exterior noise levels exceed 60 Ld„/CNEL,the code stipulates that an acoustical analysis <br /> shall be performed and submitted before construction. The acoustical analysis is required to establish mitigation <br /> measures that will limit maximum interior Ld„/CNEL levels to 45 dBA in any inhabitable room. Although there <br /> are no generally applicable interior noise standards pertinent to all uses, Califoraiia communities typically adopt <br /> an Ld./CNEL standard of 45 dBA as a maximum limit on interior noise in all residential units. <br /> The State of California has also developed land use compatibility guidelines for community noise environments. <br /> The California State General Plan Guidelines,published by the State Office of Planning and Research(State of <br /> California 2003),provides guidance for the acceptability of projects in specific L&fCNEL contours. Generally, <br /> residential uses are considered to be acceptable in areas where exterior noise levels do not exceed 60 dBA <br /> L&/CNEL. The guidelines also establish exterior noise level standards for other land use types. For instance,noise <br /> _ exposure levels that are less than 75 LddCNEL are considered normally acceptable for industrial land uses,and <br /> levels less than 70 Ld,fCNEL are considered normally acceptable for office buildings and commercial and <br /> professional land uses. However,the state stresses that these guidelines can be modified to reflect sensitivities of <br /> individual communities to noise. <br /> REGIONAL AND LOCAL REGULATIONS <br /> San Joaquin General Plan 2010 <br /> The San Joaquin County General Plan Noise Element establishes specific policies to ensure acceptable noise <br /> environments for each land use.Applicable policies include: <br /> Policy 1.The following exterior noise levels shall be considered acceptable: <br /> 65 dB Ldp or less for residential development. <br /> . 60 dB Lin or less for schools,group care facilities, and hospitals. <br /> ► Policy 4.Development shall be planned and designed to minimize noise impacts on neighboring noise- <br /> sensitive areas and to minimize noise interference from outside noise sources. <br /> Policy 6.The county shall seek to alleviate existing community noise problems. <br /> ► Implementation 8 (Setbacks).
