Setbacks to fences or walls enclosing private yards,patios or courtyards shall <br /> be 5 feet. <br /> a. Encroachments of up to 3 feet are allowed for short (less than 15') lengths <br /> of fence or wall. <br /> b. An exception is allowed where a soundwall or community wall separates <br /> the project from an arterial or collector street. In this case, the soundwall <br /> will be within the right-of-way, with a return fence or wall to the house. <br /> c. An exception is allowed where a fence or wall is 36" or less in height, in <br /> which case the fence or wall shall have a minimum setback to public right- <br /> of-way of 2 feet. <br /> 5. Setbacks to retaining walls from public rights-of-way shall be a minimum of <br /> 18", unless the retaining of grade is accomplished as part of a soundwall or <br /> community wall. <br /> 5.4 Building-to-Building Setbacks <br /> 1. Attached Dwelling Units: No building-to-building setback is required for <br /> attached units,provided building code requirements are met. <br /> 2. Building-to-Building: Where two residential structures are not attached, the <br /> setback from habitable structure to habitable structure shall be a minimum of <br /> 8 feet. <br /> a. Non,-habitable portions of the residential structure, such as (but not limited <br /> to) chimneys, media niches, eaves or other projections may encroach into <br /> this setback. <br /> b. The separation between residential structures including(but not limited to) <br /> chimneys, media niches, eaves, etc., shall conform to building code <br /> requirements. <br /> 3. Shared Drives: Setbacks from building to building on the 1st floor across a <br /> shared drive shall be a minimum of 30 feet. <br /> 4. Shared Drives: Shared drives shall maintain a zone clear of obstructions a <br /> minimum of 20 feet wide and 13.5' high. <br /> 5. Paseos: Setbacks from building to building where buildings front on to each <br /> other across a pedestrian paseo shall be a minimum of 25' (excluding covered <br /> porches, balconies, fenced or walled courtyards, bay windows, eaves,media <br /> niches, chimneys or other projections from the main building). No fences, <br /> walls or other structures appurtenant to private dwellings may be constructed <br /> within a zone a minimum of 10' wide along the paved pedestrian path in said <br /> paseo. <br /> 6.
