(Habitat Assessment page 11.)-The applicant will request coverage'under the SJMSCP and comply with-the measures in the SJMSCP and the Specific Plan III for the protection.of kit fbx.. The rationale with respect to the third finding ("habitat of superior quality and superior or comparable quality will be created or restored to compensate for the ` loss") is as follows: l The applicant'will create or restore habitat of superior quantity and superior or i comp arable,quality to compensate for the loss of wetlands as result of the project. Prior to the'approval of the Final Map(s) for the project,.the applicant will submit to the Community Development Department a Wetland' Mitigation/Replacement Plan (Wetland Plan) prepared by a qualifled biologist. The Wetland Plan will include the following provisions which are incorporated as Tentative Map Conditions of Approval. r a) There shall be no degradation of the habitat or numbers of any rare, threatened;or endangered plant,or animal species as a result of the project. b) Wetland habitat of superior quantity and superior or comparable.quaiity will be created or restored to compensate for the loss General Plan Policy VI, G, 1). Replacement vegetation generally shall be native vegetation (General Plan,Volume 1, Policy Vl, G, 15). c) 1.02 acres of wetland will be filled as a result of the project(Draft Wetland l Delineation Report Golden State Investments It, LP Property February 2006). The applicant shall replace the lost wetland with 1.02 acres of wetland (General Plan, Volume I, Policy VI, G, 5; Master Plan, Implementation 7.3.6 (b))• d) The Wetland Plan shall be consistent with all Federal, State,and local regulations(Master Plan, Implementation 7.3.6(k); Specific Plan III, Implementation Measure 7.3.4.3 (e)). e) The Wetland Plan shall show the location and extent of existing wetlands on the site of the proposed project. f) The Wetland Plan shall indicate sites that are to be developed or preserved to serve as mitigation for loss of wetlands as a result of the proposed project. To the extent practical, mitigation sites shall be in the Mountain House Creek corridor. If replacement in the Mountain House Creek corridor is not feasible, replacement shall be within San Joaquin County_ g) Provisions shall be made for maintaining replacement wetland for a minimum of five (5)years. h Assurance of wetlandreservation shall b p e by conservation easement or other acceptable methods. l In addition to the above,with regard to riparian habitat, the applicant will prepare a Riparian Habitat Mitigation Plan for the elimination of riparian habitat on the site, pursuant to Community Development Department Condition of 3 l _ l
