1. All in-tract landscaping and utility RMI areas and all other landscape areas within <br /> Specific Plan III that were not in the original Master Plan,the MHCSD Parks, Recreation <br /> and Leisure Plan,the TIF or the CFF(January, 2003)as determined by MHCSD,will <br /> require a-funding mechanism as Bete Inedby.MHCSD 'These'areas will require <br /> establishment of a maintenance entity or financing mechariisrn acceptable to MHCSD to <br /> provide funding for maintenance of, and if necessary;replacement,at the end of the <br /> useful life of improvements including, but not lirbited to landscaping, pathways; walls, <br /> and all improvements serving or for the special benefit of this subdivision. This <br /> subdivision shall'be a part of the financing mechanlsm.(Lighting and Landscape <br /> 'Maintenance District)to be`establishee for the entire SP III Open Space Corridor <br /> System. The financing mechanisnilsliail be�corbpleted an adopted bythe Board of <br /> Directors prior to the approval of the First Ficial Map: <br /> J. A continuous 8-foot wide Landscape Buffer/Easertient and Agricultural Fence'per <br /> Specific Plan III Implementation Measures 3.2.3.3(c)and (e)shall be provided. All <br /> Improvements shall be consistent with all Community Approvals including applicable <br /> provisions of the MHCSD Design Manual and Standards. <br /> - <br /> K. Continuous Wal!and Agricultural Fence Maintenance Access.Easements shall_ be <br /> provided as required by the MHCSD. <br /> 33. AIB Neighborhood Parks:.' <br /> A. The neighborhood parks identified within Specific Plan III shall be dedicated to MHCSD <br /> or an offer of dedication to the MHCSD shall be recorded with the First Final Map. T <br /> Timing: condition shall be met with approval of First Final Map of Neighborhood AIB. <br /> B. The Neighborhood AIB Parks shall be designed consistent with all Community <br /> Approvals including applicable provisions of the Parks, Recreation and Leisure Plan and <br /> the MHCSD Design Manual. The design of the parks shall be reviewed and approved <br /> by MHCSD. Timing: condition shall be met prior to approval of First Final Map. <br /> C. The MHCSD General Manager may allow the Neighborhood Parks to be constructed in <br /> phases to be consistent with usage demand and other public interest considerations. <br /> Construction of the first phase of the neighborhood park shall begin no later than the <br /> time at which 50% of the dwelling units for Neighborhood AIB (separate from <br /> Neighborhood D)or school attendance area, whichever is sooner, have been issued a <br /> building permit. The Park shall be completed no later than the time at which 80% of <br /> dwelling units for the neighborhood have been issued building permits. Completion time <br /> may be modified by the MHCSD General Manager to reflect construction,weather, <br /> budget, or other public interest contingencies. <br /> D. A formal agreement for joint use of parks and recreation facilities with adjacent K-8 <br /> schools shall be required prior to construction of the park. (Implementation Measure <br /> 7.2.2.34) <br /> E. The A/B Neighborhood 2.5 acre Park shall be constructed or bonded for at the discretion <br /> of the MHCSD at the time 50% of the dwelling unit permits for this subdivision have had <br /> their Final Inspection. Completion time may be modified by the MHCSD General <br /> Manager to reflect construction, weather, budget, or other public interest contingencies <br /> 34. South Community Park: <br /> A. Community Park land identified within Specific Plan III shall be dedicated to MHCSD on <br /> a minimum of a pro rata basis, as determined by MHCSD,with the applicant to pay fair <br /> share of all park improvements.
